“Am primit refuz la rezidență și am aplicat la viza de familie ca să fiu în ordine”

Am văzut destul de des postări în care persoane care au primit refuz la aplicații de rezidență ca membri de familie au continuat să rămână în UK după refuz afirmând că au aplicat pentru viză de familie, ca să fie în ordine cu actele.

Lucrurile stau diferit cu aplicatul pentru viza din interiorul UK și, de fapt, ori nu au aplicat pentru viză de familie ori, pentru ca nu știu legile și nu citesc dinainte pe site-ul guvernului, au fost păcalite și li s-a “vândut” aplicația la rezidență ca fiind pentru viză, de catre diverși “experți”, contabili wannabe, falși avocați sau simpli țepari.

Când nu poți obține o viză de familie
Nu poți aplica pentru o viză de familie sau schimba către o viză de familie când ești în UK cu o viză de vizitator sau o viză pentru 6 luni sau mai puțin.

Va trebui să părăsești UK pentru a aplica pentru o viză de familie:

  • dacă ai permisiunea de a fi în UK ca vizitator (și când treceți ca turiști pe la e-gates tot permisiune de vizitator primiți din partea sistemului, chiar dacă nu aveți standard visitor visa sau ștampilă cu 6 luni în pașaport)
  • dacă viza ta este pentru 6 luni sau mai puțin

Poți schimba către o viză de familie în UK doar dacă ești intrat deja cu o viză de familie de 6 luni ca logodnic, logodnică sau partener civil propus sau dacă ai permisiunea de a rămâne în UK pentru soluționarea unui proces în instanța de familie sau a unui divorț.

La fel, nu poți aplica pentru o viză de familie dacă membrul tău de familie (persoana în baza căreia aplici) se află temporar în UK cu o viză de muncă sau viză de student. În situația asta, poți aplica în schimb pentru a rămâne cu ei ca dependant.

Deci ca să fie lucrurile clare, nu poți să vii ca turist, să aplici la rezidență ca membru de familie și să primești refuz, după care să aplici la viza de familie în timp ce te afli încă în UK.

Cum poți să vii legal la muncă în UK după 1 ianuarie 2021 – ghidul noului venit

Pentru cei care vor să vină să muncească în UK

dacă n-ai mai fost niciodată în UK sau ai fost mai demult în trecere, și ești tentat să vii sau te-a chemat careva aici, trebuie să știi că regulile s-au schimbat și nu mai intri direct pe piața muncii ca înainte, când veneai ca turist și te angajai pe baza de buletin/pașaport și nino. Din 1 ianuarie 2021, ai nevoie de viză de muncă.

Ce înseamnă asta pentru tine:

  • Nu poți lucra fără viză dacă ai venit după 1 ianuarie 2021.
  • Ai nevoie de o calificare din lista agreată de guvern și de o ofertă de muncă de la o firmă din UK care este autorizată să sponsorizeze. Firma îți dă un document numit certificat de sponsorizare.
  • Trebuie să aplici pentru viză înainte să vii în UK. Totul se face online, din țara de origine.

Ce ar trebui să faci mai întâi? Să te informezi cum stau lucrurile, ce înseamnă sistemul de vize, cum se aplică, dacă meseria în care ești calificat e eligibilă pentru sponsorizare, ce documente îți trebuie, cât te costă viza, cum să te ferești de scam cu actele, de promisiunile țeparilor, unde să găsești informații oficiale și unde să găsești suport.

Ce să nu faci: în primul rând să nu te pui la drum fără actele necesare. Să nu ceri pe social media să ți se facă acte, să nu abordezi triliardele de pagini de facebook care promit acte în UK, că nu așa se fac vizele, să nu te încrezi în promisiunile unora și altora că îți fac ei vize și îți dau și job. Să verifici tot ce ți se spune, la sursă, pe site-ul guvernului, nu cu ChatGPT și să verifici pe oricine te abordează dacă pretinde că e contabil, avocat, consilier de imigrație care se ocupa cu acte, să nu răspunzi la mesaje suspecte pe care nu le-ai solicitat, să nu trimiți nimănui în privat documentele tale personale și date sensibile, să nu trimiți bani în avans pentru acte în conturile care ți se dau în privat, pentru că taxele pentru aplicația de viză nu se plătesc decât la Home Office, online. Nu tot ce zboară se mănâncă.

Lista salariilor de imigrare pentru skilled worker visa

Poți verifica ce locuri de muncă se află pe lista salariilor de imigrare ( immigration salary list) în fiecare regiune din UK

Dacă locul tău de muncă se află pe listă, salariul minim este 80% din rata minimă obișnuită a traseului pentru a te califica pentru o viză Skilled Worker sau Health and Care Worker.

Salariile anuale pentru aceste locuri de muncă sunt calculate pe baza unei săptămâni de lucru de 37,5 ore. Acestea trebuie calculate proporțional, pe baza numărului de ore lucrate pe săptămână declarate de angajatorul tău.

Dacă nu știi codul ocupațional (codul jobului tău), poți căuta locul de muncă aici: CASCOT occupation coding tool.

Dacă te califici pentru rata standard, deoarece ai obținut certificatul de sponsorizare după 4 aprilie 2024, ar trebui să consulți coloana “standard rate”.

Dacă te califici pentru rata redusă, ar trebui să consulți coloana “lower rate”, la care te califici dacă se aplică oricare dintre următoarele:  

  • aplici pentru o viză Health and Care Worker în anumite ocupații
  • ai obținut certificat de sponsorizare pentru prima ta viză Skilled Worker înainte de 4 aprilie 2024 și ai deținut continuu una sau mai multe vize Skilled Worker de atunci

Pe 4 decembrie 2023, Home Secretary a anunțat mai multe modificări ale sistemului de imigrație, legate de ruta Skilled Worker (SW)

Anunțul guvernului – care urmează să fie implementat începând cu aprilie 2024 – include:

  • Shortage Occupation List (SOL) va fi înlocuită cu Immigration Salary List (ISL);
  • Eliminarea reducerii de 20% din ‘going rate’, care anterior era un beneficiu al includerii unei ocupații pe SOL;
  • Ruta SW (cu excepția vizei Health & Care worker (H&CW)):
    • Pragul general a fost majorat de la £26,200 la £38,700. Aceasta reprezintă o creștere de la 25% la 50% (mediana) a ocupațiilor eligibile pentru ruta SW, împreună cu o actualizare a celor mai recente date salariale nominale (Annual Survey of Hours and Earnings – ASHE);

Documente necesare pentru viza de muncă în UK – ghid de aplicare

Pentru viza de muncă se aplică online, din țara de origine, odată ce ai gata toate documentele pregătite. Documentele necesare pentru aplicarea la viza de muncă (skilled worker visa):

  • numărul certificatului de sponsorizare( certificate of sponsorship reference number) – vi-l dă angajatorul
  • dovada cunoștintelor de limba engleză (proof of your knowledge of English )
  • pașaport valid
  • numele jobului si salariul anual cu care vei fi angajat
  • codul ocupațional al jobului pentru care aplici
  • numele angajatorului și numărul licenței lui de sponsor( le găsești pe certificatul de sponsorizare)

Cere angajatorului o copie dupa certificatul de sponsorizare dacă nu ai una.

Alte documente care s-ar putea să trebuiască

Funcție de situație, s-ar putea să ți se ceară și:

  • dovada că ai suficiente fonduri să te întreții în UK ( personal savings to support yourself in the UK ) – și anume un extras bancar din care să reiasă că ai cel puțin  £1,270 în cont ( dacă în certificatul de sponsorizare angajatorul nu a specificat că îți acoperă el costurile de întreținere )
  • dovada relației cu soțul/a și copiii tăi – dacă aplică și ei cu tine ca dependenți
  • certificat de Cazier Judiciar( criminal record certificate) – dacă vei lucra pe un job într-un domeniu în care este obligatoriu acesta. (detalii aici : https://www.gov.uk/government/publications/criminal-records-checks-for-overseas-applicants/countries-q-z#romania )
  • certificatul tău PhD , sau numărul tău de referință Ecctis (fostul număr de referință NARIC ) dacă calificarea ta e obținută în afara UK( va trebui să aplici prin Ecctis – apply through Ecctis )

Dacă documentele nu sunt în limba engleză, trebuie să prezinți traducerea lor legalizată.

Viza de muncă – Skilled Worker visa

Ruta lucrătorilor calificați (Skilled Worker visa)

Orice aplicant care întrunește criteriile de eligibilitate prezentate mai jos poate obține o viză de Lucrător calificat (Skilled worker visa).

Viza se acordă pentru o perioadă de 5 ani. La expirarea vizei se poate solicita prelungirea sau se poate aplica pentru obținerea statutului de rezident permanent IRL (‘indefinite leave to remain’) dacă se întrunesc condițiile.

1. Pentru a obține pentru o viză de muncitor calificat, trebuie:
– să ai o ofertă de muncă de la un angajator din UK cu licență de sponsor.
-să ai un „certificat de sponsorizare” de la acel angajator cu informații despre jobul care ți s-a oferit în UK
– să faci o muncă care se află pe lista ocupațiilor eligibile (eligibilitatea depinde de jobul dvs)
-să fii plătit cel puțin cu salariul minim pentru tipul de job pentru care aplici- cât anume depinde de tipul de muncă pe care o desfășurați
-să cunoști limba engleză ( trebuie să fii capabil sa vorbești, să citești, să scrii și să înțelegi engleza la nivel B1, atașand documentele care confirmă acest nivel )

! Eligibilitatea depinde de tipul meseriei. Înainte de a afla dacă o anume meserie este eligibilă sau dacă se pot obține puncte tranzacționabile, este necesar să știți codul ocupațional. Fiecare solicitant trebuie să obțină 70 de puncte pentru a f eligibil. Primele 50 de puncte se obțin pe criterii fixe/obligatorii, iar următoarele 20 au caracter tranzacțional.

Dacă aplicantul câştigă doar salariul minim (pragul minim de salariu pentru toţi lucrătorii calificaţi) nu primește nici un punct pentru a-și întregi punctajul. Doar în cazul în care aplicantul este persoană nou-intrată pe piaţa muncii din Marea Britanie, cerinţa salariului va fi cu 30% mai scăzută decât cea pentru lucrătorii cu experienţă.

Regimul de vize și condițiile de călătorie pentru cetățenii români în UK

Începând cu data de 1 ianuarie 2021, Regatul Unit al Marii Britanii și Irlandei de Nord si-a asumat pe deplin statutul de stat terț în relația cu statele Uniunii Europene, inclusiv cu România. Din această perspectivă, regimul de vize și condițiile de călătorie pentru cetățenii europeni, inclusiv cei români, s-au schimbat.

În acest context, Ministerul Afacerilor Externe/ Ministry of Foreign Affairs, Romania face următoarele precizări:

✅Conform noilor reglementări anunțate de Regatul Unit al Marii Britanii și Irlandei de Nord, începând cu 1 ianuarie 2021, cetățenii români pot intra pe teritoriul Regatului Unit pentru șederi de scurtă durată (ex. în scop turistic, în vizită etc.) pentru o perioadă de până la 6 luni într-un an, fără a avea nevoie de o viză de intrare. Cu toate acestea, cetățenii români care doresc să muncească în cele 6 luni trebuie să obțină, în prealabil, o viză de intrare.

✅Cetățenii români cu settled si pre-settled status pe schema de rezidențe EUSS vor putea să călătorească în UK folosind documentele naționale de identitate până la data de 31 decembrie 2025.

⚠Cetățenii români care doresc să se deplaseze pe teritoriul UK pentru o durată mai mare de șase luni (pentru activități de muncă, pentru studii etc.) au nevoie, începând cu data de 1 ianuarie 2021, de viză din partea autorităților britanice. Sunt două modalități pentru obținerea vizei, astfel:

✅Cetățenii români posesori ai unui pașaport simplu electronic pot obține viza online, prin accesarea paginii : https://www.gov.uk/browse/visas-immigration).

În cadrul acestui portal, solicitanții au la dispoziție un ghid conținând procedura detaliată de obținere a vizei. Persoanele care posedă un pașaport biometric vor putea completa cererea, inclusiv confirmarea identității, utilizând o aplicație pentru telefoane inteligente (tip smartphone). MAE subliniază că solicitările pentru obținerea vizei nu se pot depune în baza cărții de identitate.

✅Cetățenii români care nu dețin pașaport simplu electronic și aplică în baza unui pașaport simplu temporar trebuie să depună documentația personal la centrul regional pentru vize din România – Bucharest Visa Application Centre, DBH-Group Serviced office, adresa: București, sector 1, strada Buzești nr. 50-52, et.2 Business Center. 👍Autoritățile britanice au operaționalizat deja procedurile pentru primirea de solicitări de viză în următoarele scopuri: studii, activități de muncă (muncitori calificați, lucrători înalt calificați în anumite domenii/Global Talent, personal medical și asistenți), afaceri (inovare, desfășurarea de afaceri tip start-up).

⚠⚠Pentru orice persoană care are mențiuni înscrise în cazierul judiciar, precum și cele cărora le-a fost refuzată, în trecut, intrarea pe teritoriul UK, autoritățile britanice recomandă depunerea unei cereri pentru obținerea vizei și pentru deplasările de scurtă durată (sub 6 luni), potrivit datelor comunicate prin intermediul portalului https://www.gov.uk/browse/visas-immigration.

MAE precizează că aceste noi condiții sunt rezultatul deciziei autorităților britanice, care, de la data de 1 ianuarie 2021, au implementat un nou sistem de imigrație bazat pe puncte (point-based immigration system – PBS).

Nu puteți să aplicați pentru viză de muncă, atunci când vă aflați în UK ca turist

Pot intra în Marea Britanie ca turist și solicita viza pentru skilled worker visa după sosirea în UK?

Raspuns: NU.

Printre categoriile care nu pot solicita viză de lucrător calificat se numără:

  • vizitatorii
  • studenții pe termen scurt
  • părinții unui copil care se află la școală în Marea Britanie
  • lucrătorii sezonieri
  • lucrător la curățenie într-o gospodărie privată
