“Am primit refuz la rezidență și am aplicat la viza de familie ca să fiu în ordine”

Am văzut destul de des postări în care persoane care au primit refuz la aplicații de rezidență ca membri de familie au continuat să rămână în UK după refuz afirmând că au aplicat pentru viză de familie, ca să fie în ordine cu actele.

Lucrurile stau diferit cu aplicatul pentru viza din interiorul UK și, de fapt, ori nu au aplicat pentru viză de familie ori, pentru ca nu știu legile și nu citesc dinainte pe site-ul guvernului, au fost păcalite și li s-a “vândut” aplicația la rezidență ca fiind pentru viză, de catre diverși “experți”, contabili wannabe, falși avocați sau simpli țepari.

Când nu poți obține o viză de familie
Nu poți aplica pentru o viză de familie sau schimba către o viză de familie când ești în UK cu o viză de vizitator sau o viză pentru 6 luni sau mai puțin.

Va trebui să părăsești UK pentru a aplica pentru o viză de familie:

  • dacă ai permisiunea de a fi în UK ca vizitator (și când treceți ca turiști pe la e-gates tot permisiune de vizitator primiți din partea sistemului, chiar dacă nu aveți standard visitor visa sau ștampilă cu 6 luni în pașaport)
  • dacă viza ta este pentru 6 luni sau mai puțin

Poți schimba către o viză de familie în UK doar dacă ești intrat deja cu o viză de familie de 6 luni ca logodnic, logodnică sau partener civil propus sau dacă ai permisiunea de a rămâne în UK pentru soluționarea unui proces în instanța de familie sau a unui divorț.

La fel, nu poți aplica pentru o viză de familie dacă membrul tău de familie (persoana în baza căreia aplici) se află temporar în UK cu o viză de muncă sau viză de student. În situația asta, poți aplica în schimb pentru a rămâne cu ei ca dependant.

Deci ca să fie lucrurile clare, nu poți să vii ca turist, să aplici la rezidență ca membru de familie și să primești refuz, după care să aplici la viza de familie în timp ce te afli încă în UK.

Cum stă treaba cu “am voie să stau 6 luni in UK”

Întrebare: ”Daca o persoana din EU vine in UK in vizita la rude, prieteni etc, si sta 6 luni pe an, asta se considera ca locuieste aici? Deci vine 6 luni, pleaca, sta 6 luni in Ro, vine iar 6 luni”.

Răspuns: Rob Mar:  ”Doua comentarii importante (ce adreseaza direct ce intrebi tu + o “poama” similara care tot apare pe grupurile de romani)

1a) Legea (Appendix V) se refera DIRECT si EXPLICIT la ce intrebi tu aici. Si zice asa, in Paragraful. V 4.2.b. unde defineste “a genuine visitor” (adica un vizitator care chiar e vizitator): “will not live in the UK for extended periods through frequent or successive visits, or make the UK their main home” (adica un vizitator care chiar e vizitator nu va locui in Marea Britanie pentru perioade lungi de timp sau prin intermediul unor vizite frecvente sau al unor vizite repetate).

Evident exista exceptii, insa in >99% din cazurile cu “stat in Ro 6 luni, apoi in UK 6 luni” se incalca direct si flagrant setul de legi care guverneaza obligatiile vizitatorilor, chit ca provin dintr-o tara care necesita viza inainte de intrarea in UK, chit ca sunt dintr-o tara care nu necesita viza inainte de intrarea in UK.

Ca cineva sa fie vizitator veritabil, viata lor trebuie sa fie in alta tara. Si aici nu vorbim despre un calcul de zile (6 luni), calcul care de altfel nici nu exista explicit in lege, ci vorbim efectiv despre CENTRUL VIETII LOR. Cand ai sot/sotie in UK si vii la el/ea cate 6 luni pe an, este IMPOSIBIL ca centrul vietii tale sa mai fie in Romania. Pentru ca sotul/sotia nu locuieste in Romania, pentru ca e foarte probabil ca nu ai un job in Romania (ce job te asteapta sa fii plecat 6 luni pe an?), pentru ca e foarte probabil ca sursa principala de venit sa fie castigurile sotului/sotiei din UK.

Si aici, ca mica adaugire, trebuie vorbit despre bunici. Un lucru pe care marea majoritate a oamenilor il uita/ignora/nu il stiu este ca a avea grija de nepoti este munca. Un vizitator (chiar si bunic, deci membru de familie al minorilor) care vine sa stea cu copii FACE MUNCA. Iar acest lucru este in lege de cand a pierdut Home Office faimosul proces Sawmynaden din 2012 si apoi Theresa May (la vremea respectiva ministru de interne) a cerut schimbarea legilor, astfel incat sa se interzica explicit astfel de cazuri. Da, poate parea cruzime, insa este lege. Si tot ce e nevoie e un vecin (un curtain-twitcher) care nu are ce face si e mult prea plictisit cu viata proprie, sa o vada pe maica-ta/sa il vada pe taica-tu plimbandu-ti copilul cu caruciorul sau la parc 2-3 zile la rand. Vecin care nu te place si are mai mult decat un neuron functional (adica stie unde sa faca raport). Acest raport dureaza, pe ceas, 1 minut si 40 de secunde. Si pentru ca implica minor, va fi 99% investigat. Si se descopera ca bunicul/bunica nu e in vizita, ci e babysitter.

1b) Strans legata de cele scrise mai sus este conceptia gresita ca romanii (si detinatorii de pasapoarte europene) nu pot aplica de viza de vizitator. AU CONTRAIRE. Nu numai ca pot, dar ar si trebui sa o faca, MAI ALES CEI CARE PLANUIESC SA FIE 6 LUNI IN RO SI 6 LUNI IN UK, CU ANII. Nu numai pentru linistea lor, sa nu le tremure fundurile de fiecare data cand se dau jos din avion in UK, dar pentru ca este singura forma legala de a te asigura ca nu incalci AppendixV, si ca nu iti faci din UK “casa” prin acele vizite repetate sau vizite pe perioade mai lungi de care vorbeam mai sus. Aplici la viza, care poate fi pe 6 luni, pe 1, 2, 5, sau 10 ani, si apoi ai EXPLICIT permisiunea din partea Regatului Unit sa vii sa stai cate 6 luni pe an in UK [https://www.gov.uk/standard-visitor]

2. “Am pasaport european/romanesc, deci am voie sa stau 6 luni in UK.”

Toate afirmatiile astea cu “am voie” sunt amuzante, daca nu ar fi triste. Si daca nu ar fi motivul pentru care suntem cap de lista (cu sutele in fiecare saptamana) la procedurile IS81/82 (adica arest) pe toate aeroporturile din UK.

Nu, nimeni nu “ARE VOIE” sa vina in UK doar pentru ca are pasaport European. Si nu ma refer la introducerea ETA, care urmeaza anul asta. Ma refer la dreptul de a veni in UK. Nu este un drept implicit pe care ti-l da pasaportul. Nu e un drept dat de dumnezeu. Nu e un drept dat de mos craciun. Sau de sfanta paraschiva. Sau de cainele vecinei de la 3. Nu e un drept de altfel. Este o permisiune pe care o ceri (ori prin viza ori de la frontiera) si care ti se da daca esti considerat vizitator veritabil.

Repet: IN LEGE NU EXISTA DREPTUL AUTOMAT PE CARE IL AU PERSOANELE DETINATOARE DE PASAPORT AL UNEI TARI CARE NU ARE NEVOIE DE VIZA PENTRU A INTRA IN UK IN VIZITA. SI NU EXISTA NICI PERIOADA MAXIMA PE CARE CINEVA O POATE PETRECE AICI (FAIMOSUL CALCUL DE 6 LUNI ESTE UN CALCUL PUR MATEMATIC, CALCUL MATEMATIC NEGATIV, DE INTERPRETARE A UNOR PARAGRAFE DIN LEGE)

Ca sa fii vizitator in UK trebuie sa ti se DEA voie sa fii vizitator in UK. Voie care ti se da prin viza. Sau de un nene sau o tanti la ghiseul de imigrari. Sau chiar si prin deschiderea portilor (e-gates) de la aeroport. Faptul ca acele porti ti se deschid seminifica o intreaga analiza care a fost inceputa din momentul in care ti-ai cumparat bilet de avion. Nu ti se deschid portile, fara sa fii chemat la ghiseu, doar pentru ca ai pasaport romanesc/european/american/australian/etc si pentru ca “ai dreptul “sa vii in UK in vizita.”

Cum să aplici pentru o viză ca să vii în UK

Pentru a călători în UK, fie ca să studiezi, să lucrezi, să vizitezi sau să te alături familiei, este posibil să ai nevoie de o viză. Alegerea tipului corect de viză depinde de o serie de factori, inclusiv țara de origine, scopul călătoriei, durata șederii și circumstanțele tale personale.

1. Alege tipul de viză

Următorii factori influențează tipul de viză necesară:

  • Originea: Țara din care provii poate influența dacă ai nevoie sau nu de o viză pentru a intra în Marea Britanie.
  • Scopul: Motivele pentru care dorești să călătorești în Marea Britanie (vacanță, muncă, studii etc.).
  • Durata șederii: Perioada pentru care intenționezi să rămâi în UK.
  • Circumstanțe personale: Abilitățile, calificările și alte condiții personale pot influența tipul de viză necesar.

Înainte de a aplica, verifică aici dacă ai nevoie de viză.

Dacă dorești să vizitezi UK:

Pentru a vizita UK pentru o perioadă de până la 6 luni, trebuie să aplici pentru o Standard Visitor visa pentru: vacanțe sau vizite la prieteni și familie, călătorii de afaceri sau întâlniri, cursuri pentru studii de scurtă durată. Românii ca deținători de pașapoarte europene pot veni ca turiști fără viză de vizitator. Cu toate acestea, unii ar trebui să aplice pentru această viză, mai ales cei care au aplicații la rezidență refuzate și ștampile de refuz intrare și mai ales CEI CARE PLANUIESC SA FIE 6 LUNI IN RO SI 6 LUNI IN UK, CU ANII. Viza, care poate fi pe 6 luni, pe 1, 2, 5, sau 10 ani, oferă EXPLICIT permisiunea din partea Regatului Unit să vină să stea câte 6 luni pe an în UK.

Dacă intenționezi să te vii în vizită ca să te căsătorești în UK, trebuie să aplici pentru Marriage Visitor visa. Cu o viză de turist, nu ai dreptul de a lucra în UK.

Dacă tranzitezi prin Marea Britanie

Poți avea nevoie de o viză dacă tranzitezi prin UK în drum spre o altă țară, de exemplu, dacă ai o escală între zboruri. În acest caz, trebuie să aplici pentru o viză de tranzit.

Dacă dorești să studiezi în Marea Britanie

Tipul de viză de care ai nevoie pentru a studia în UK depinde de lungimea cursului, tipul și locul de desfășurare a acestuia:

  • Standard Visitor visa: Permite efectuarea unui curs scurt de studiu de până la 6 luni.
  • Short-term study visa: Pentru cursuri de limbă engleză de peste 6 luni, dar nu mai mult de 11 luni.
  • Student visa: necesară pentru cursuri lungi. Trebuie să fii sponsorizat de un colegiu sau o universitate autorizată și să ai un loc confirmat.
  • Child Student visa: Pentru copii cu vârste între 4 și 17 ani care doresc să studieze la o școală independentă. Dacă ai peste 16 ani, această viză îți poate permite să lucrezi parțial.

Dacă dorești să lucrezi în Marea Britanie

Pentru a lucra, pe termen scurt sau lung, poți aplica pentru o viză de muncă work visa. Există mai multe tipuri de vize de muncă, în funcție de:

  • Abilitățile și calificările tale.
  • Dacă ai o ofertă de muncă și un sponsor.
  • Dacă dorești să aduci familia cu tine.
  • Activitatea pe care o vei desfășura (de exemplu, muncă sportivă, caritabilă sau religioasă).

Pentru a înființa o afacere, poți aplica pentru o Innovator Founder visa.

Dacă dorești să te alături familiei tale în UK

Dacă ești soț, partener sau un membru de familie al unei persoane cu cetățenie britanică sau cu drept de ședere în UK, poți aplica pentru o viză de familie( family visa). Familia ta trebuie să demonstreze că te poate susține financiar.

Dacă membrul familiei tale este în UK în baza unei vize

Poți aplica pentru o viză pentru a te alătura unui membru al familiei care este deja în Marea Britanie pe baza unei vize, fie

  • Soțul sau partenerul tău.
  • Părintele tău, dacă ai sub 18 ani.

Verifică ce tip de viză ai nevoie pentru a te alătura lor.

Rezidenți care se întorc

Dacă ai avut settled și ai părăsit Marea Britanie pentru mai mult de 5 ani la rând, sau ai IRL(‘indefinite leave to remain’) și ai lipsit din Uk mai mult de 2 ani, vei avea nevoie de o returning resident visa pentru a te întoarce.

2. Pregătește aplicația

Pentru viză se aplică și se plătește online. Dacă ai persoane în întreținere(dependenți) care vor să vină cu tine în UK, fiecare persoană trebuie să aplice și să plătească separat.

Când să aplici

  • Vize de vizită: Cu 3 luni înainte de data planificată a călătoriei.
  • Vize de muncă: Cu 3 luni înainte de data de începere a locului de muncă.
  • Vize de studiu: Cu 6 luni înainte de data de începere a cursului.

Cât durează să primești un răspuns

Durata pentru obținerea unei decizii depinde de tipul de viză pentru care aplici. Poți plăti pentru un răspuns mai rapid, în funcție de viză și de locația din care aplici.

Taxe

Pentru fiecare viză se plătesc taxele de aplicare(fees), iar costul depinde de tipul de viză pentru care aplici. Taxele sunt aceleași pentru fiecare membru al familiei care aplică să vină cu tine în UK.

Plăți pentru asistență medicală

Trebuie să plătești o taxă suplimentară pentru sănătate, ca parte a aplicației, dacă:

  • Aplici pentru o viză de muncă, studiu sau pentru a te alătura familiei.
  • Aplici pentru o ședere de peste 6 luni.
  • Nu aplici pentru rezidență permanentă în UK.

Poți să aplici pentru viză pentru altcineva

de exemplu pentru un copil sau pentru un membru al familiei care nu are acces la un calculator. Trebuie să ai permisiunea scrisă a persoanei respective sau a tutorelui legal, dacă persoana are sub 18 ani.

Dovada că nu ai tuberculoză (TB): cetățenii români nu au nevoie de un test TB pentru aplicația de viză.

Modificarea sau anularea aplicației de viză

Dacă vrei să modifici ceva în aplicația ta după ce ai trimis-o, contactează UK Visas and Immigration (UKVI). Poți să retragi aplicația, dar banii plătiți penru taxa de aplicare vor fi returnați doar dacă UKVI nu a început procesarea.

3. Dovedește-ți identitatea

va trebui să-ți dovedești identitatea și să furnizezi documente care să demonstreze eligibilitatea ta. Acest proces depinde de unde ești și ce tip de pașaport ai. Se poate face la un centru de aplicare pentru vize sau cu‘UK Immigration: ID Check’ smartphone app. Despre care din ele trebuie să folosești afli atunci când începi aplicația.

Dacă trebuie să mergi la un centru de aplicare a vizelor

Centrele de aplicare a vizelor sunt operate de companii externe. Vei primi un link către site-ul lor unde poți programa o întâlnire pentru a-ți furniza informațiile biometrice (amprente și fotografie).

Dacă nu îți dovedești identitatea în termen de 240 de zile de la trimiterea aplicației online, va trebui să începi o nouă aplicație.

Poți alege să utilizezi un serviciu standard sau să plătești în plus pentru servicii opționale, însă plătind pentru servicii opționale nu înseamnă că aplicația ta va avea mai multe șanse de succes.

Copiii sub 16 ani trebuie să meargă la întâlnirea la centrul de aplicare a vizelor însoțiți de un adult. Trebuie să ai documente care dovedesc că ești tutorele lor legal.

4. Primirea deciziei la aplicația de viză

Decizia va veni pe mail sau prin poștă. Dacă aplicația este aprobată, vei primi:

-un sticker în pașaport (vignette) – dacă ai dat datele biometrice la un centru de vize.
-acces ca să vizualizezi statusul de imigratie online- dacă ai folosit app-ul din telefon ca să-ți demonstrezi identitatea
Vigneta sau statusul online de imigrație îți vor arăta ce viză ți s-a acordat, data până când e valabilă și condițiile vizei care îți spun ce poți și ce nu poți face în UK ( de exemplu : ‘No access to public funds’ – nu poți solicita beneficii, ‘No work’ – nu poți munci, ‘Restricted work’ – poți munci doar pentru sponsor). Dacă ai vignetă în pașaport și vii în UK pentru mai mult de 6 luni, trebuie să îți colectezi un biometric residence permit (BRP) după ce ajungi în UK în termen de 10 zile de la data sosirii.

Dacă aplicația ta este refuzată, vei primi un mail care explică de ce aplicația a fost respinsă. Scrisoarea de refuz va menționa dacă ai dreptul la administrative review sau immigration decision appeal, dar nu toate tipurile de vize permit aceste contestații.

Dacă ai nevoie de asistență suplimentară, este recomandat să consulți un consilier în imigrație autorizat.
