Măsurile anunțate în Immigration White Paper

Măsurile prezentate în documentul publicat de către Home Office, astăzi pe 12 mai, vor remodela sistemul britanic de imigrație, restabilind ordinea într-un sistem eșuat care a dus la cvadruplarea migrației nete între 2019 și 2023.

În rezumat, politicile-cheie din planul de 82 de pagini, intitulat Restoring Control over the Immigration System, includ următoarele:

Reducerea imigrației

  • Reducerea numărului de imigranți cu aproximativ 100.000 de persoane pe an
  • Va fi introdusă legislație care să precizeze clar că Guvernul și Parlamentul, nu instanțele de judecată, decid cine are dreptul să rămână în UK – vizând abuzul de Articolul 8 (right to family life) folosit pentru a bloca deportările.

Măsuri privind munca ilegală și criminalitatea

  • Se vor înăspri regulile aplicate atât la frontieră, cât și în sistemul de imigrație, pentru a refuza intrarea sau azilul celor care încalcă legea.
  • Atunci când o persoană încalcă regulile sau legile, să existe puteri mai mari de aplicare a legii, inclusiv localizare, arestare și deportare.
  • Cetățenii străini condamnați pentru infracțiuni vor fi marcați chiar și dacă nu au primit pedeapsă cu închisoarea; noile praguri pentru deportare vor reflecta gravitatea faptelor, inclusiv violența împotriva femeilor și fetelor.
  • Procedurile de deportare a infractorilor străini vor fi simplificate, cu măsuri suplimentare împotriva celor care comit infracțiuni curând după sosire.
  • Migranții vor fi obligați să dețină identitate digitală (eVize), care vor înlocui cardurile BRP – Biometric Residence Permits.
  • Controale mai stricte pentru cei care abuzează sistemul de imigrație sau care vin cu intenția de a cere azil fără un motiv real, când nu există o schimbare semnificativă în țara lor de origine.
  • Se continuă combaterea muncii ilegale, inclusiv în gig economy, folosind vizele electronice(eVisa) și tehnologie biometrică în razii sprijinite de cei 1.000 de angajați relocați către executare și deportări.
  • Controalele bancare vor fi actualizate pentru a reflecta schimbările tehnologice și a combate frauda, inclusiv evaziunea fiscală.
  • Se va face presiune asupra guvernelor străine care refuză să-și primească cetățenii înapoi.
  • Vor putea fi impuse sancțiuni financiare și pedepse sponsorilor (angajatori sau instituții) care abuzează sistemul de imigrație.

Reforme privind munca

  • Muncitorii calificați vor trebui să aibă diplome universitare pentru a veni în UK, iar pragul salarial va crește.
  • Taxa de competențe pentru imigrație – plătită de angajatorii sponsori – va crește cu 32%, pentru prima dată din 2017, conform inflației.
  • Se vor închide vizele pentru health care pentru noii solicitanți; persoanele deja în UK cu drept de muncă pot prelungi sau schimba viza până în 2028, sub rezerva unei revizuiri.
  • Se va crea un nou Grup de Evidență a Pieței Muncii (Labour Market Evidence Group), care va folosi date îmbunătățite în baza cărora se vor lua deciziile privind locurile de muncă și politica de migrație.
  • Accesul la sistemul de imigrație bazat pe puncte va fi limitat la ocupațiile deficitare pe termen lung, pentru o perioadă limitată de timp, acolo unde Comitetul Consultativ pentru Migrație (MAC) recomandă că este justificat și unde există o strategie pentru forța de muncă din sectoarele cheie care se bazează puternic pe recrutarea internațională. Angajatorii care doresc să recruteze din străinătate trebuie să crească recrutarea din forța de muncă internă.
  • Se va introduce o Listă Temporară a Deficitului de Forță de Muncă, care va permite acces limitat în timp la sistemul de imigrație pe bază de puncte pentru rolurile sub nivelul RQF 6.
  • Immigration Salary List (lista salariilor pentru imigrație), care oferea reduceri de la pragurile salariale, va fi desființată
  • Anumiți refugiați recunoscuți de ONU și persoane strămutate cu competențele necesare vor putea aplica prin ruta muncitorilor calificați.
  • Se vor deschide mai multe rute pentru persoane cu înaltă calificare să lucreze în UK.

Reforme privind studiile

  • Absolvenții internaționali vor putea rămâne în UK doar 18 luni după finalizarea studiilor din UK, față de 2 ani în prezent.
  • Se ia în considerare o taxă pe veniturile generate de studenții internaționali, iar fondurile ar putea fi direcționate către formarea forței de muncă locale.
  • Instituțiile care sponsorizează studenți vor avea condiții mai stricte pentru a putea recruta din străinătate.
  • Nota de trecere pentru indicatorii de conformitate va crește cu 5%, astfel încât sponsorii vor trebui să aibă o rată de înscriere de cel puțin 95% și o rată de finalizare de 90%.
  • Se va introduce un sistem de rating Roșu-Galben-Verde care va arăta nivelul de conformitate al fiecărui sponsor.
  • Sponsorii aflați în risc de neconformitate pot fi supuși unor planuri de acțiune și restricții privind numărul de studenți internaționali pe care îi pot aduce.
  • Instituțiile care folosesc agenți de recrutare din străinătate vor trebui să se înscrie în Cadrul de Calitate pentru Agenți, pentru a garanta standarde ridicate.
  • Universitățile și colegiile vor trebui să demonstreze că au luat în considerare impactul local atunci când planifică recrutarea de studenți internaționali.
  • Organismele care acreditează cursuri de studiu pe termen scurt vor fi revizuite pentru a întări controalele înainte și în timpul acreditării.

Măsuri pentru integrare și coeziune socială

  • Cerințele de limbă engleză pentru lucrătorii calificați și alte categorii vor crește de la nivelul B1 la B2 (utilizator independent conform CEFR).
  • Dependenții adulți ai lucrătorilor și studenților vor trebui să atingă cel puțin nivelul A1, cu planuri de creștere treptată.
  • La prelungirile de viză se va cere dovada progresului spre nivelul A2, iar pentru stabilirea permanentă va fi necesar nivelul B2.
  • Majoritatea rutelor de settlement vor avea ca cerință nivelul B2, în loc de B1.
  • Crește perioada standard necesară pentru obținerea statutului de rezident permanent la zece ani, pentru cei veniți pe sistemul de imigrație Points-Based System(cu vize de muncă)
  • Cei care aduc contribuții semnificative la economia sau societatea britanică ar putea obține stabilire și cetățenie mai rapid.
  • Membrii de familie ai cetățenilor britanici pot obține rezidență permanentă după cinci ani, iar protecțiile pentru victimele violenței domestice rămân în vigoare.
  • Părinții copiilor britanici sau cu statut stabilit care mor vor putea rămâne permanent în UK imediat.
  • Testul „Viața în UK” (necesar pentru cetățenie sau stabilire) va fi revizuit și îmbunătățit, iar costurile pentru cetățenie britanică ar putea fi reduse pentru tinerii care au trăit în UK cea mai mare parte a vieții.
  • Tinerii care au crescut în UK fără statut legal vor fi sprijiniți să obțină drept de ședere permanent, cu ajutor suplimentar pentru cei din sistemul de protecție a copilului.

Lista salariilor de imigrare pentru skilled worker visa

Poți verifica ce locuri de muncă se află pe lista salariilor de imigrare ( immigration salary list) în fiecare regiune din UK

Dacă locul tău de muncă se află pe listă, salariul minim este 80% din rata minimă obișnuită a traseului pentru a te califica pentru o viză Skilled Worker sau Health and Care Worker.

Salariile anuale pentru aceste locuri de muncă sunt calculate pe baza unei săptămâni de lucru de 37,5 ore. Acestea trebuie calculate proporțional, pe baza numărului de ore lucrate pe săptămână declarate de angajatorul tău.

Dacă nu știi codul ocupațional (codul jobului tău), poți căuta locul de muncă aici: CASCOT occupation coding tool.

Dacă te califici pentru rata standard, deoarece ai obținut certificatul de sponsorizare după 4 aprilie 2024, ar trebui să consulți coloana “standard rate”.

Dacă te califici pentru rata redusă, ar trebui să consulți coloana “lower rate”, la care te califici dacă se aplică oricare dintre următoarele:  

  • aplici pentru o viză Health and Care Worker în anumite ocupații

Revizuirea Immigration Salary List

Pe 4 decembrie 2023, Home Secretary a anunțat mai multe modificări ale sistemului de imigrație, legate de ruta Skilled Worker (SW)

Anunțul guvernului – care urmează să fie implementat începând cu aprilie 2024 – include:

  • Shortage Occupation List (SOL) va fi înlocuită cu Immigration Salary List (ISL);
  • Eliminarea reducerii de 20% din ‘going rate’, care anterior era un beneficiu al includerii unei ocupații pe SOL;
  • Ruta SW (cu excepția vizei Health & Care worker (H&CW)):
    • Pragul general a fost majorat de la £26,200 la £38,700. Aceasta reprezintă o creștere de la 25% la 50% (mediana) a ocupațiilor eligibile pentru ruta SW, împreună cu o actualizare a celor mai recente date salariale nominale (Annual Survey of Hours and Earnings – ASHE);
    • Creșterea pragurilor specifice ocupației de la 25% la 50% (mediana) a salariului cu normă întreagă pentru ocupațiile non-H&CW sau la scara națională de salarizare, acolo unde este aplicabil; și,
    • Pentru ocupațiile de pe ISL, un prag de fie £30,960 sau pragul specific ocupației respective, oricare este mai mare.

Viza Heath&Care Workers:

  • O excepție care are scopul de a “continua să aducă lucrătorii din domeniul sănătății de care sectorul de îngrijire și NHS-ul au nevoie”;
  • Pragul general de £29,000 în loc de £38,700.

Cum poți să primești ajutor gratuit cu aplicația la rezidență, cetățenie britanică sau viză

Dacă ai nevoie de ajutor ca să completezi o aplicație Home Office, ca de exemplu cea la rezidență, pentru că nu te pricepi să completezi formulare online, sau nu te pricepi să folosești computerul sau un smartphone, sau nu ai acces la vreunul din ele, sau dacă nu ai acces la internet, nu ai nevoie să apelezi la “contabili” și aplicatori contracost –> poți primi gratuit asistență de la guvern prin serviciul We Are Digital’ . Pentru asta trebuie să te afli în UK.

Acest ajutor este valabil pentru diverse tipuri de aplicații

  • pentru aplicarea la rezidență (settled, pre-settled)
  • cetățenie britanică
  • student visa (viza de student)
  • viză de muncă (skilled worker visa – daca sponsorul nu te poate ajuta)

Poți primi ajutor: 1) față în față la un centru de suport; 2) prin telefon, de la un advisor calificat care o sa te ajute să completezi online aplicația; 3)acasă la tine – un tutor al acestui serviciu te va vizita acasă și te va ajuta la completarea aplicației.

Ce fel de ajutor nu poți primi: prin acest serviciu nu vei primi sfaturi de imigrație, sau informații despre stadiul sau statusul unei aplicații.

Documente necesare pentru viza de muncă în UK – ghid de aplicare

Pentru viza de muncă se aplică online, din țara de origine, odată ce ai gata toate documentele pregătite. Documentele necesare pentru aplicarea la viza de muncă (skilled worker visa):

  • numărul certificatului de sponsorizare( certificate of sponsorship reference number) – vi-l dă angajatorul
  • dovada cunoștintelor de limba engleză (proof of your knowledge of English )
  • pașaport valid
  • numele jobului si salariul anual cu care vei fi angajat
  • codul ocupațional al jobului pentru care aplici
  • numele angajatorului și numărul licenței lui de sponsor( le găsești pe certificatul de sponsorizare)

Cere angajatorului o copie dupa certificatul de sponsorizare dacă nu ai una.

Alte documente care s-ar putea să trebuiască

Funcție de situație, s-ar putea să ți se ceară și:

  • dovada că ai suficiente fonduri să te întreții în UK ( personal savings to support yourself in the UK ) – și anume un extras bancar din care să reiasă că ai cel puțin  £1,270 în cont ( dacă în certificatul de sponsorizare angajatorul nu a specificat că îți acoperă el costurile de întreținere )
  • dovada relației cu soțul/a și copiii tăi – dacă aplică și ei cu tine ca dependenți
  • certificat de Cazier Judiciar( criminal record certificate) – dacă vei lucra pe un job într-un domeniu în care este obligatoriu acesta. (detalii aici : https://www.gov.uk/government/publications/criminal-records-checks-for-overseas-applicants/countries-q-z#romania )
  • certificatul tău PhD , sau numărul tău de referință Ecctis (fostul număr de referință NARIC ) dacă calificarea ta e obținută în afara UK( va trebui să aplici prin Ecctis – apply through Ecctis )

Dacă documentele nu sunt în limba engleză, trebuie să prezinți traducerea lor legalizată.

Viza de muncă – Skilled Worker visa

Ruta lucrătorilor calificați (Skilled Worker visa)

Orice aplicant care întrunește criteriile de eligibilitate prezentate mai jos poate obține o viză de Lucrător calificat (Skilled worker visa).

Viza se acordă pentru o perioadă de 5 ani. La expirarea vizei se poate solicita prelungirea sau se poate aplica pentru obținerea statutului de rezident permanent IRL (‘indefinite leave to remain’) dacă se întrunesc condițiile.

1. Pentru a obține pentru o viză de muncitor calificat, trebuie:
– să ai o ofertă de muncă de la un angajator din UK cu licență de sponsor.
-să ai un „certificat de sponsorizare” de la acel angajator cu informații despre jobul care ți s-a oferit în UK
– să faci o muncă care se află pe lista ocupațiilor eligibile (eligibilitatea depinde de jobul dvs)
-să fii plătit cel puțin cu salariul minim pentru tipul de job pentru care aplici- cât anume depinde de tipul de muncă pe care o desfășurați
-să cunoști limba engleză ( trebuie să fii capabil sa vorbești, să citești, să scrii și să înțelegi engleza la nivel B1, atașand documentele care confirmă acest nivel )

! Eligibilitatea depinde de tipul meseriei. Înainte de a afla dacă o anume meserie este eligibilă sau dacă se pot obține puncte tranzacționabile, este necesar să știți codul ocupațional. Fiecare solicitant trebuie să obțină 70 de puncte pentru a f eligibil. Primele 50 de puncte se obțin pe criterii fixe/obligatorii, iar următoarele 20 au caracter tranzacțional.

Dacă aplicantul câştigă doar salariul minim (pragul minim de salariu pentru toţi lucrătorii calificaţi) nu primește nici un punct pentru a-și întregi punctajul. Doar în cazul în care aplicantul este persoană nou-intrată pe piaţa muncii din Marea Britanie, cerinţa salariului va fi cu 30% mai scăzută decât cea pentru lucrătorii cu experienţă.

Aplicantul trebuie să demonstreze că îndeplinește criteriile relevante, respectiv punctajul necesar tipului de viză pentru care se depune cererea.
