Cum e cu “cine mă ajută cu semnătură pentru pașaportul britanic?”

Când aplici pentru cetățenia britanică, fie pentru tine, fie pentru copilul tău, trebuie să prezinți doi referees care îți susțin cererea. Alegerea acestora nu este o simplă formalitate.

Însă în ultimii ani a devenit o obișnuință/ modalitate de a face bani din a confirma identitatea contra cost, anumite persoane oferindu-se să semneze ca referee pentru persoane pe care nu le cunosc. Chiar dacă persoana care semnează are profesia, funcția sau cetățenia britanică necesară pentru a putea fi referee, acest lucru nu este suficient pentru a îndeplini cerințele legale.

Un referee trebuie să fie cetățean britanic și să dețină un pașaport britanic valabil și să fie ori o persoană cu profesie, fie să aibă peste 25 de ani. Celălalt referee poate avea orice naționalitate, însă trebuie să fie o persoană cu profesie acceptată (accountant, barrister, solicitor, dentist, engineer cu calificări profesionale, Post Office official, journalist, teacher, police officer, civil servant, member of Parliament, minister of a recognised religion, nurse, social worker, surveyor, precum și numeroase alte profesii recunoscute de Home Office).

Un referee nu poate fi rudă cu tine, nu poate fi rudă cu celălalt referee, nu poate fi solicitorul sau agentul(contabil,etc) care ți-a făcut aplicația la cetățenie și care te reprezintă în această cerere. De asemenea, Home Office nu acceptă un referee care a fost condamnat pentru o infracțiune pedepsită cu închisoarea în ultimii 10 ani.

Conform Home Office, la aplicația de cetățenie britanică, fiecare referee trebuie să te cunoască de cel puțin 3 ani. Pentru confirmarea identității pentru pașaportul britanic, referee trebuie să cunoască solicitantul de cel puțin 2 ani. Declarația pe care o face nu privește doar identitatea ta, ci și faptul că te cunoaște personal și poate confirma informațiile pe care le furnizează. Furnizarea de informații false sau înșelătoare poate duce la refuz și poate afecta viitoarele aplicații de imigrare.

Pe lângă faptul că se fac verificările de rigoare dacă aceștia îndeplinesc condițiile prevăzute și dacă informațiile pe care le furnizează sunt adevărate ( că referees nu au unspent convictions, că sunt calificați să acționeze ca referees și că semnăturile lor sunt autentice), un caseworker Home Office poate contacta direct referees pentru a clarifica orice nelămuriri privind aplicația, pentru a verifica exactitatea informațiilor și le poate adresa întrebări referitoare la caracterul tău sau la capacitatea ta de a înțelege implicațiile dobândirii cetățeniei britanice.

Dacă un referee face în mod deliberat declarații false, de exemplu afirmând că te cunoaște de o anumită perioadă sau că relația dintre voi este alta decât în realitate, acesta poate fi urmărit penal în baza section 46(1) of the British Nationality Act 1981. Aceleași principii se aplică tuturor cazurilor de declarații false.

Home Office acordă o atenție deosebită persoanelor suspectate că au făcut declarații false în mai multe aplicații de cetățenie. Dacă există indicii că același referee a furnizat informații false în mod repetat, aceste situații sunt analizate cu atenție și investigate.

De asemenea, aplicația la cetățenie va fi refuzată dacă un referee a fost implicat în orice formă de înșelăciune în cei 10 ani anteriori depunerii cererii de cetățenie. În acest scop, înșelăciunea este considerată că continuă până la data la care este descoperită sau recunoscută.

Atât tu, cât și referees trebuie să știți că declarațiile false pot conduce la sancțiuni și pot determina retragerea certificatului de cetățenie dacă acesta a fost obținut prin fraudă, false representation sau concealment of material facts.

Prin urmare, dacă o persoană plătește un referee pe care nu îl cunoaște, iar acesta declară că o cunoaște de cel puțin 3 ani, sau denaturează natura relației cu aplicantul, Home Office o tratează ca o formă de deception (înșelăciune) în cadrul cererii de cetățenie și poate avea consecințe atât pentru referee, cât și pentru solicitantul cetățeniei.

Consecințele pentru referee:

-poate fi urmărit penal în baza section 46(1) of the British Nationality Act 1981 pentru declarații false făcute cu bună știință sau din neglijență;
-riscă până la 3 luni de închisoare, o amendă de până la £5.000 sau ambele.

Consecințele pentru solicitantul cetățeniei:

-chiar dacă nu este începută o urmărire penală, aplicația va fi, în mod normal, refuzată dacă există motive să se creadă că ai determinat un referee să facă declarații false sau ai fost complice la înșelăciunea acestuia.
-cererea va fi în mod normal refuzată dacă a existat orice formă de deception din partea unui referee în cei 10 ani anteriori cererii tale de cetățenie;
-dacă declarația falsă este descoperită după acordarea cetățeniei, certificatul de cetățenie poate fi retras dacă a fost obținut prin fraud, false representation or concealment of material facts.
