“Am primit refuz la rezidență și am aplicat la viza de familie ca să fiu în ordine”

Am văzut destul de des postări în care persoane care au primit refuz la aplicații de rezidență ca membri de familie au continuat să rămână în UK după refuz afirmând că au aplicat pentru viză de familie, ca să fie în ordine cu actele.

Lucrurile stau diferit cu aplicatul pentru viza din interiorul UK și, de fapt, ori nu au aplicat pentru viză de familie ori, pentru ca nu știu legile și nu citesc dinainte pe site-ul guvernului, au fost păcalite și li s-a “vândut” aplicația la rezidență ca fiind pentru viză, de catre diverși “experți”, contabili wannabe, falși avocați sau simpli țepari.

Când nu poți obține o viză de familie
Nu poți aplica pentru o viză de familie sau schimba către o viză de familie când ești în UK cu o viză de vizitator sau o viză pentru 6 luni sau mai puțin.

Va trebui să părăsești UK pentru a aplica pentru o viză de familie:

  • dacă ai permisiunea de a fi în UK ca vizitator (și când treceți ca turiști pe la e-gates tot permisiune de vizitator primiți din partea sistemului, chiar dacă nu aveți standard visitor visa sau ștampilă cu 6 luni în pașaport)
  • dacă viza ta este pentru 6 luni sau mai puțin

Poți schimba către o viză de familie în UK doar dacă ești intrat deja cu o viză de familie de 6 luni ca logodnic, logodnică sau partener civil propus sau dacă ai permisiunea de a rămâne în UK pentru soluționarea unui proces în instanța de familie sau a unui divorț.

La fel, nu poți aplica pentru o viză de familie dacă membrul tău de familie (persoana în baza căreia aplici) se află temporar în UK cu o viză de muncă sau viză de student. În situația asta, poți aplica în schimb pentru a rămâne cu ei ca dependant.

Deci ca să fie lucrurile clare, nu poți să vii ca turist, să aplici la rezidență ca membru de familie și să primești refuz, după care să aplici la viza de familie în timp ce te afli încă în UK.

Cum poți să vii legal la muncă în UK după 1 ianuarie 2021 – ghidul noului venit

Pentru cei care vor să vină să muncească în UK

dacă n-ai mai fost niciodată în UK sau ai fost mai demult în trecere, și ești tentat să vii sau te-a chemat careva aici, trebuie să știi că regulile s-au schimbat și nu mai intri direct pe piața muncii ca înainte, când veneai ca turist și te angajai pe baza de buletin/pașaport și nino. Din 1 ianuarie 2021, ai nevoie de viză de muncă.

Ce înseamnă asta pentru tine:

  • Nu poți lucra fără viză dacă ai venit după 1 ianuarie 2021.
  • Ai nevoie de o calificare din lista agreată de guvern și de o ofertă de muncă de la o firmă din UK care este autorizată să sponsorizeze. Firma îți dă un document numit certificat de sponsorizare.
  • Trebuie să aplici pentru viză înainte să vii în UK. Totul se face online, din țara de origine.

Ce ar trebui să faci mai întâi? Să te informezi cum stau lucrurile, ce înseamnă sistemul de vize, cum se aplică, dacă meseria în care ești calificat e eligibilă pentru sponsorizare, ce documente îți trebuie, cât te costă viza, cum să te ferești de scam cu actele, de promisiunile țeparilor, unde să găsești informații oficiale și unde să găsești suport.

Ce să nu faci: în primul rând să nu te pui la drum fără actele necesare. Să nu ceri pe social media să ți se facă acte, să nu abordezi triliardele de pagini de facebook care promit acte în UK, că nu așa se fac vizele, să nu te încrezi în promisiunile unora și altora că îți fac ei vize și îți dau și job. Să verifici tot ce ți se spune, la sursă, pe site-ul guvernului, nu cu ChatGPT și să verifici pe oricine te abordează dacă pretinde că e contabil, avocat, consilier de imigrație care se ocupa cu acte, să nu răspunzi la mesaje suspecte pe care nu le-ai solicitat, să nu trimiți nimănui în privat documentele tale personale și date sensibile, să nu trimiți bani în avans pentru acte în conturile care ți se dau în privat, pentru că taxele pentru aplicația de viză nu se plătesc decât la Home Office, online. Nu tot ce zboară se mănâncă.

Astăzi, guvernul a anunțat modificarea regulilor privind absențele pentru persoanele cu pre-settled status.
Cei cu pre-settled vor putea obține statutul de settled dacă pot dovedi că au locuit în UK cel puțin 30 de luni din ultimele 60 de luni. Oricare 30 DE LUNI. Modificarea va intra în vigoare pe 16 iulie.

Ca să nu existe confuzii: această schimbare nu înseamnă ca poți aplica de settled de îndată ce ai 30 de luni in UK. Regula că trebuie să fi locuit în UK timp de 5 ani întregi a rămas, doar modul în care sunt calculate absențele s-a schimbat. În acești 5 ani (60 de luni) trebuie să demonstrați că ați locuit aici cel puțin 30 de luni.

ETA – pe scurt

ETA (Electronic Travel Authorisation) este o permisiune de călătorie pentru cei care vin în vizită în Marea Britanie, care în prezent nu au nevoie de viză pentru vizite scurte, sau care nu au deja un statut de imigrație în UK.

ETA este o permisiune de călătorie – nu este o viză. Nu permite și nu garantează intrarea în Marea Britanie – doar autorizează o persoană să călătorească spre Marea Britanie.

Europenii pot călători cu ETA începand cu 2 aprilie 2025.

Cum se aplică pentru ETA? prin aplicatia „aplicația UK ETA”, care o descărcați din Google Play sau Apple App Store. Puteți aplica online pe GOV.UK dacă nu aveți acces la un smartphone sau aplicați pentru altcineva. Majoritatea solicitanților primesc o decizie automată în câteva minute, ceea ce înseamnă că în continuare se poate călători spontan în UK (totuși se recomandă să aplicați în avans cu cel puțin 3 zile lucrătoare, în caz că situația necesită analiză suplimentară).

Pentru a aplica pentru ETA trebuie să:

  • Plătiți taxa de £16 (inițial costa £10) .
  • Dați date de contact și detalii despre pașaport
  • Furnizați o fotografie valabilă, conform regulilor HO pentru fotografii digitale
  • Răspundeți la câteva întrebări: dacă aveți job sau nu, dacă aveți și altă naționalitate, dacă aveți condamnări, dacă ați fost implicat /suspect în crime de război, terorism, extremism.

Trebuie să călătoriți cu pașaportul pe care l-ați folosit atunci când ați aplicat pentru ETA.

ETA permite călătorii multiple în UK pentru șederi de până la șase luni pe parcursul a doi ani sau până la expirarea pasaportului – oricare dintre acestea se întâmplă mai devreme.

Reamintim cine nu are nevoie de ETA :

-dacă sunteți scutit de controlul imigrației (exempt from immigration control), dacă aveți o viză, dacă aveți statut de settled sau pre-settled sau right of abode, dacă sunteți în tranzit printr-un aeroport din UK și nu veți trece prin controlul de frontieră, dacă sunteți cetățean britanic sau irlandez, dacă călătoriți cu un pașaport de cetățean al teritoriilor britanice de peste mări (British overseas territories citizen), dacă călătoriți cu un pașaport de British National (Overseas), dacă locuiți în Irlanda și călătoriți din Irlanda, Guernsey, Jersey sau Insula Man, dacă sunteți un copil care călătorește folosind formularul de informații de călătorie pentru excursiile școlare Franța-UK (France-UK school trip travel information form).

Ce se intamplă daca cineva nu poate obține ETA?

Daca cererea de ETA a unei persoane este respinsă, i se va comunica motivul si poate aplica din nou.

Daca vi se refuză ETA, nu puteți face apel și trebuie sa aplicați pentru o viză dacă doriți în continuare permisiunea de a veni în UK.

Este nevoie de ETA pentru cei care tranziteaza prin Marea Britanie? Daca da, de ce?

Guvernul a agreat o excepție temporară pentru pasagerii care tranzitează aerian (airside), si prin urmare, nu trec prin controlul de frontieră al Marii Britanii, de a avea nevoie de ETA. Excepția va fi revizuită periodic.

Pasagerii care tranzitează UK trecând prin controlul de frontieră al Marii Britanii vor avea în continuare nevoie de ETA.

Cum funcționează ETA în Irlanda de Nord?

Marea Britanie nu opereaza control de imigratie la granita terestra Irlanda-Irlanda de Nord, pentru calatoriile din cadrul Common Travel Area. Însă toți cei care sosesc în UK, inclusiv cei care intra prin Irlanda de Nord, trebuie sa respecte Regulile de Imigratie ale Marii Britanii, inclusiv obținerea ETA daca sunt eligibili.

Cetățenii britanici și irlandezi nu au nevoie de ETA și nici rezidentii non-irlandezi cu nationalitati care nu au nevoie de viză pentru UK( cetățenii europeni și americani), cu condiția să aibă dovezi acceptabile ale statusului lor de rezidență. Ghidul complet poate fi gasit aici. Daca acestia calatoresc în UK din afara Common Travel Area, vor avea nevoie de ETA.

Important!

-aplicați pe site-ul oficial. Nu pe orice site vă iese in cale pe google.

-sunt o mulțime de site-uri fake care promit ETA sau care imită site-ul guvernului britanic și care taxează sume mult mai mari ca să aplicați. Evitați-le!

-nu mai plătiți pe alții ca să vă aplice. Datele voastre personale esențiale ajung pe mâna unor necunoscuți.

-raportați suspiciuni de escrocherii online legate de imigrație aici: Avoid and report internet scams and phishing

-verificați dacă aveți ETA sau dacă aplicația a fost primită aici, pe chat: ETA Webchat.

-dacă aveți nevoie de informații despre ETA, luați-le de la sursă, de pe Gov.uk.


În caz că vă întrebați de ce a fost introdusă ETA: că ajută la securitatea frontierelor Marii Britanii, pentru că persoanele care aplică pentru ETA dau detalii biografice, biometrice si de contact și raspund la întrebarile despre eligibilitate si cazier. Pentru Home Office asta înseamnă că vor avea mai multe informații despre cei care vor sa vina în UK, dinainte de îmbarcare și așa previne sosirea celor care prezinta o amenințare.

Ce-ar trebui să ai de la un immigration adviser acreditat

E plin pe social media și în special pe grupurile de facebook, de persoane/conturi/pagini care se pretind immigration adviseri sau avocați de imigrație, și-ți suflă în ceafă vânând orice postare unde cineva cere ajutor specializat, furând identități, date personale și înșelând oamenii. Unii mai țepari, doar să le ia banii la disperați, alții mai cu ștaif, cu carte de vizită că lucrează la Home Office, cu postări pro făcute cu Chat GPT, că sunt contabili autorizați(lol) sau că sunt specialiști în imigrație. Oricine poate să își facă un cont și să pretindă orice.

Scopul acestui ghid este să vă ajute să înțelegeți cum arată o relație corectă și legală între client și adviser și să puteți recunoaște din timp practicile incorecte sau ilegale.

1) Ce trebuie să faceți dacă aveți nevoie de un specialist pe imigrație? În primul rând, înainte de orice discuție, să verificați orice nume vi se propune, orice nume din anunț, din reclamă, pagina de Fb sau recomandare și nu mai trimiteți bani oricui pretinde ca e avocat/specialist. Dacă nu are nicio metodă de contact decât mesaj privat sau whatsapp, evitați. Iar dacă vă mai și abordează primul în privat, hmm, e mai mult decît dubios.

Dacă aveți nevoie de immigration adviser, folosiți Immigration Advice Authority (IAA) Adviser Finder ca să vă găsiți un specialist în imigrație acreditat, în zona în care locuiți. Ca să verificați dacă e acreditat, îl căutați aici: Adviser register. Toți consilierii în domeniul imigrației trebuie să fie înregistrați la IAA sau să fie membri ai unui organism profesional aprobat.

Dacă aveți nevoie de avocați care oferă consultanță în materie de imigrație, puteți găsi solicitors aici :

Un avocat vă poate ajuta să gestionați cazul și să găsiți un barrister.

Ce pot face immigration adviserii: au voie să vă ofere sfaturi doar în situațiile pe nivelul la care sunt calificați. Puteți vedea ce tip de consultanță pot oferi în funcție de nivelul lor. Există 3 niveluri.

-cei de nivelul 1 – pot oferi doar consultanță și asistență pentru cazuri simple, fără probleme și unde aveți toate documentele necesare pentru : entry clearance, leave to enter, leave to remain, nationality and citizenship, EU și EEA law.

-cei de nivelul 2 – pot face tot ceea ce pot face consilierii de nivel 1, dar pot accepta și cazuri mai complicate, de ex. dacă ați avut probleme anterioare cu imigrarea și doriți permisiunea de a rămâne în UK. Ei pot ajuta și cu: cereri de azil și aplicații pentru drepturile omului (human rights applications), situațiile în care ați intrat ilegal în UK sau ați rămas după expirarea vizei, administrative review, dacă sunteți supus deportării sau expulzării.

-cei de nivel 3 pot face tot ceea ce pot face consilierii de nivel 1 și 2 și doar ei vă pot reprezenta la un tribunal de imigrare.

Verificați dacă un consilier în imigrație este autorizat să vă ofere consultanța de care aveți nevoie înainte de a apela la el.

2)Când vă luați un consilier în imigrație:

  • aflați cât percepe pentru servicii și dacă va trebui să îl plătiți
  • solicitați o chitanță semnată și datată dacă îi plătiți orice sumă de bani
  • întrebați cât veți avea de plătit dacă decideți să nu mai folosiți serviciile lui
  • conveniți asupra sumei de plată înainte ca acesta să facă orice muncă pentru voi.

Unii consilieri nu percep taxe pentru serviciile lor. Totuși, chiar dacă nu vă taxează, va trebui să plătiți pentru orice cheltuieli suplimentare, cum ar fi costurile pentru traduceri și taxele de aplicare.

⚠ ATENȚIE:

Ca potențial client, immigration adviser-ul trebuie să vă dea o scrisoare de confirmare a serviciilor numită Client Care Letter, înainte de a începe să lucreze pentru voi, nu după. Clientul trebuie să semneze scrisoarea sau să își confirme acordul prin e-mail înainte de a începe orice activitate.

Client Care Letter trebuie să conțină:

-numele organizației/adviser-ului, că sunt reglementați de IAA și nivelul la care sunt autorizați, numărul de înregistrare IAA, mențiunile prevăzute în Codul de Standarde (inclusiv despre asigurarea de răspundere profesională) – care confirmă că acesta are competența de a examina dosarul clientului;

-datele de contact ale consilierului care gestionează cazul, inclusiv numele, adresa, numărul de telefon și adresa de e-mail

-ce anume tip de muncă va face pentru voi (detalii complete privind instrucțiunile primite de la client, consilierea oferită și activitatea convenită a fi prestată, inclusiv termenele estimate)

-cât veți fi taxat (confirmarea costurilor estimate sau convenite, ce costuri suplimentare pot apărea, dacă este cazul)

-cum și când veți efectua plata

-o mențiune privind statutul de imigrație al clientului, dacă acesta este cunoscut

-confirmarea faptului că organizația păstrează responsabilitatea integrală pentru toate activitățile desfășurate în numele clientului

-o trimitere la procedura de soluționare a plângerilor

De ce insist cu Client Care Letter? Pentru că această scrisoare este parte din aplicația de acreditare a adviserului/organizației, care trebuie să trimita la Immigration Advice Authority un şablon de Client Care Letter care să respecte în totalitate toate cerințele Codurilor 23–26, astfel încât IAA să poată fi satisfăcută că aplicația respectă Codurile relevante înainte de aprobarea acreditării. Dacă nu vă dă această scrisoare înseamnă că nu e acreditat. Iar dacă nu e acreditat, e criminal offence să presteze servicii de imigrație fără a fi acreditat.

Chiar dacă sunteți abordați de contabili care promit că vă rezolvă cazul, pentru că lucrează cu specialiști în imigrație, trebuie să vă spună cu cine, ca să îl puteți verifica și tot trebuie să vă dea această Care letter, din partea acelui specialist.

În concluzie, dacă persoana care vă propune servicii de imigrație nu e de găsit în lista oficială de acreditați, nu vă oferă scrisoarea Client Care Letter, nu vă dă o chitanță datată și semnată pentru banii primiți și vă cere să trimiteți banii pe revolut sau în conturi de terți cu referință gift sau mai stiu eu ce, fugiți, că vă luați țeapă.

*Codul de Standarde 2024, item 5.3–5.4: Organi­zațiile regulate trebuie să furnizeze un client care letter eficient și să păstreze dovezi că clientul a agreat conținutul (semnat/confirmat) înainte de începerea lucrului.
