Home Office închide conturile bancare ale celor care rămân ilegal în UK

Vă aduceți aminte de pasajul acela de pe scrisorile de refuz la rezidență, despre consecințele rămânerii în UK după refuz, fără permisiunea de a face acest lucru? Adică șederea ilegală?

Printre consecințe erau și: refuzul accesului la un cont bancar și precum și închiderea sau înghețarea contului, iar banii din cont blocați până la părăsirea țării.

Iacătă că Home Office se ține de cuvânt și închide conturile bancare ale celor care nu au permisiunea de a rămâne în UK. Conform Secțiunii 40G din Immigration Act 2014 (așa cum a fost modificată prin Immigration Act 2016), Home Office a notificat banca că are obligația de a închide contul unei persoane fără drept de ședere.

Astăzi, guvernul a anunțat modificarea regulilor privind absențele pentru persoanele cu pre-settled status.
Cei cu pre-settled vor putea obține statutul de settled dacă pot dovedi că au locuit în UK cel puțin 30 de luni din ultimele 60 de luni. Oricare 30 DE LUNI. Modificarea va intra în vigoare pe 16 iulie.

Ca să nu existe confuzii: această schimbare nu înseamnă ca poți aplica de settled de îndată ce ai 30 de luni in UK. Regula că trebuie să fi locuit în UK timp de 5 ani întregi a rămas, doar modul în care sunt calculate absențele s-a schimbat. În acești 5 ani (60 de luni) trebuie să demonstrați că ați locuit aici cel puțin 30 de luni.

Măsurile prezentate în documentul publicat de către Home Office, astăzi pe 12 mai, vor remodela sistemul britanic de imigrație, restabilind ordinea într-un sistem eșuat care a dus la cvadruplarea migrației nete între 2019 și 2023.

În rezumat, politicile-cheie din planul de 82 de pagini, intitulat Restoring Control over the Immigration System, includ următoarele:

Reducerea imigrației

Reducerea numărului de imigranți cu aproximativ 100.000 de persoane pe an
Va fi introdusă legislație care să precizeze clar că Guvernul și Parlamentul, nu instanțele de judecată, decid cine are dreptul să rămână în UK – vizând abuzul de Articolul 8 (right to family life) folosit pentru a bloca deportările.

Măsuri privind munca ilegală și criminalitatea

Se vor înăspri regulile aplicate atât la frontieră, cât și în sistemul de imigrație, pentru a refuza intrarea sau azilul celor care încalcă legea.
Atunci când o persoană încalcă regulile sau legile, să existe puteri mai mari de aplicare a legii, inclusiv localizare, arestare și deportare.
Cetățenii străini condamnați pentru infracțiuni vor fi marcați chiar și dacă nu au primit pedeapsă cu închisoarea; noile praguri pentru deportare vor reflecta gravitatea faptelor, inclusiv violența împotriva femeilor și fetelor.
Procedurile de deportare a infractorilor străini vor fi simplificate, cu măsuri suplimentare împotriva celor care comit infracțiuni curând după sosire.
Migranții vor fi obligați să dețină identitate digitală (eVize), care vor înlocui cardurile BRP – Biometric Residence Permits.
Controale mai stricte pentru cei care abuzează sistemul de imigrație sau care vin cu intenția de a cere azil fără un motiv real, când nu există o schimbare semnificativă în țara lor de origine.
Se continuă combaterea muncii ilegale, inclusiv în gig economy, folosind vizele electronice(eVisa) și tehnologie biometrică în razii sprijinite de cei 1.000 de angajați relocați către executare și deportări.
Controalele bancare vor fi actualizate pentru a reflecta schimbările tehnologice și a combate frauda, inclusiv evaziunea fiscală.
Se va face presiune asupra guvernelor străine care refuză să-și primească cetățenii înapoi.
Vor putea fi impuse sancțiuni financiare și pedepse sponsorilor (angajatori sau instituții) care abuzează sistemul de imigrație.

Reforme privind munca

Muncitorii calificați vor trebui să aibă diplome universitare pentru a veni în UK, iar pragul salarial va crește.
Taxa de competențe pentru imigrație – plătită de angajatorii sponsori – va crește cu 32%, pentru prima dată din 2017, conform inflației.
Se vor închide vizele pentru health care pentru noii solicitanți; persoanele deja în UK cu drept de muncă pot prelungi sau schimba viza până în 2028, sub rezerva unei revizuiri.
Se va crea un nou Grup de Evidență a Pieței Muncii (Labour Market Evidence Group), care va folosi date îmbunătățite în baza cărora se vor lua deciziile privind locurile de muncă și politica de migrație.
Accesul la sistemul de imigrație bazat pe puncte va fi limitat la ocupațiile deficitare pe termen lung, pentru o perioadă limitată de timp, acolo unde Comitetul Consultativ pentru Migrație (MAC) recomandă că este justificat și unde există o strategie pentru forța de muncă din sectoarele cheie care se bazează puternic pe recrutarea internațională. Angajatorii care doresc să recruteze din străinătate trebuie să crească recrutarea din forța de muncă internă.
Se va introduce o Listă Temporară a Deficitului de Forță de Muncă, care va permite acces limitat în timp la sistemul de imigrație pe bază de puncte pentru rolurile sub nivelul RQF 6.
Immigration Salary List (lista salariilor pentru imigrație), care oferea reduceri de la pragurile salariale, va fi desființată
Anumiți refugiați recunoscuți de ONU și persoane strămutate cu competențele necesare vor putea aplica prin ruta muncitorilor calificați.
Se vor deschide mai multe rute pentru persoane cu înaltă calificare să lucreze în UK.

Reforme privind studiile

Absolvenții internaționali vor putea rămâne în UK doar 18 luni după finalizarea studiilor din UK, față de 2 ani în prezent.
Se ia în considerare o taxă pe veniturile generate de studenții internaționali, iar fondurile ar putea fi direcționate către formarea forței de muncă locale.
Instituțiile care sponsorizează studenți vor avea condiții mai stricte pentru a putea recruta din străinătate.
Nota de trecere pentru indicatorii de conformitate va crește cu 5%, astfel încât sponsorii vor trebui să aibă o rată de înscriere de cel puțin 95% și o rată de finalizare de 90%.
Se va introduce un sistem de rating Roșu-Galben-Verde care va arăta nivelul de conformitate al fiecărui sponsor.
Sponsorii aflați în risc de neconformitate pot fi supuși unor planuri de acțiune și restricții privind numărul de studenți internaționali pe care îi pot aduce.
Instituțiile care folosesc agenți de recrutare din străinătate vor trebui să se înscrie în Cadrul de Calitate pentru Agenți, pentru a garanta standarde ridicate.
Universitățile și colegiile vor trebui să demonstreze că au luat în considerare impactul local atunci când planifică recrutarea de studenți internaționali.
Organismele care acreditează cursuri de studiu pe termen scurt vor fi revizuite pentru a întări controalele înainte și în timpul acreditării.

Măsuri pentru integrare și coeziune socială

Cerințele de limbă engleză pentru lucrătorii calificați și alte categorii vor crește de la nivelul B1 la B2 (utilizator independent conform CEFR).
Dependenții adulți ai lucrătorilor și studenților vor trebui să atingă cel puțin nivelul A1, cu planuri de creștere treptată.
La prelungirile de viză se va cere dovada progresului spre nivelul A2, iar pentru stabilirea permanentă va fi necesar nivelul B2.
Majoritatea rutelor de settlement vor avea ca cerință nivelul B2, în loc de B1.
Crește perioada standard necesară pentru obținerea statutului de rezident permanent la zece ani, pentru cei veniți pe sistemul de imigrație Points-Based System(cu vize de muncă)
Cei care aduc contribuții semnificative la economia sau societatea britanică ar putea obține stabilire și cetățenie mai rapid.
Membrii de familie ai cetățenilor britanici pot obține rezidență permanentă după cinci ani, iar protecțiile pentru victimele violenței domestice rămân în vigoare.
Părinții copiilor britanici sau cu statut stabilit care mor vor putea rămâne permanent în UK imediat.
Testul „Viața în UK” (necesar pentru cetățenie sau stabilire) va fi revizuit și îmbunătățit, iar costurile pentru cetățenie britanică ar putea fi reduse pentru tinerii care au trăit în UK cea mai mare parte a vieții.
Tinerii care au crescut în UK fără statut legal vor fi sprijiniți să obțină drept de ședere permanent, cu ajutor suplimentar pentru cei din sistemul de protecție a copilului.

Trecerea automată de la Pre-settled la Settled -actualizare importantă

Home Office a început procesul de trecere automată a unor persoane de la statutul de pre-settled la settled. Deocamdată, acest lucru se aplică doar cetățenilor europeni care au început să locuiască în UK înainte de 31 decembrie 2020. Cetățenii non-europeni ar putea fi incluși în viitor.

Cum funcționează procesul:

🔹 Cu aproximativ 1 lună înainte ca statutul pre-settled să expire, veți primi un mail care vă anunță că statusul va fi prelungit cu 5 ani.
🔹 S-ar putea să mai primiți un alt mail care spune că sunteți luați în considerare pentru obținerea statusului Settled.
🔹 Dacă aveți un National Insurance Number, Home Office va derula verificări automate cu DWP (Department for Work and Pensions) și HMRC (Her Majesty’s Revenue and Customs).
🔹 Dacă treceți aceste verificări, veți primi Settled automat, iar statusul digital va fi actualizat.
🔹 Dacă datele verificate nu sunt clare, Home Office vă va contacta pentru a vă cere mai multe informații.

✅ Dacă primiți mailul despre acordarea automată a statutului Settled, nu trebuie să faceți nimic – decât dacă vă contactează Home Office.
⚠️ Home Office încă analizează ce se va întâmpla în cazurile în care o persoană nu îndeplinește condițiile, de exemplu din cauza întreruperii prezenței continue.

Home Office intră și în „avocații” falși care oferă sfaturi ilegale de imigrație

Nu e o noutate pentru nimeni că pe facebook și tiktok, la orice postare despre probleme cu rezidența se face coadă de ajutători și recomandări, toți călare pe “pradă” – fie “contabili” specialiști, ba persoane care se dau drept avocați de imigrație, fie scameri&țepari care pretind că pot rezolva aplicațiile datorită „accesului special” la Home Office, înșelând victimele să plătească mii de lire în avans și colectând documentele lor personale de identitate. Partea bună e că Home Office e la curent cu această situație și știe despre indivizii care folosesc rețelele sociale pentru a înșela oamenii, așa că ia măsuri.

Statul englez deține tot mai multe dovezi despre cum acești „avocați” falși acționează ca intermediari pentru cei care încearcă să abuzeze de sistemul de imigrație pentru a rămâne în UK sau care încearcă să profite de disperarea oamenilor, oferind consiliere de slabă calitate sau complet frauduloasă în domeniul imigrației.

Persoanele care se dau ilegal drept avocați și consilieri în imigrație, care oferă „sfaturi” frauduloase, vor primi amenzi de până la £15,000 prin noile măsuri din proiectul de lege privind Border Security, Asylum, and Immigration Bill.

Oferirea de consiliere în imigrație fără o înregistrare adecvată la Immigration Advice Authority (IAA) sau la un organism legal de reglementare recunoscut reprezintă o infracțiune penală care poate duce la închisoare, iar IAA va primi noi puteri pentru a aplica și amenzi de până la £15,000 firmelor și persoanelor frauduloase care pretind că sunt consilieri în imigrație.

Eliminarea consilierilor falși în imigrație face parte din acțiunile acestui guvern de a crea un sistem în care regulile sunt respectate și aplicate strict și care și-a intensificat activitățile de aplicare a legii împotriva muncii ilegale, împotriva celor care exploatează migranții vulnerabili și a celor care subminează sistemul de imigrație.

Ministrul pentru Securitatea Frontierei, Dame Angela Eagle, a declarat:

„Indivizii lipsiți de rușine care oferă consiliere în imigrație complet ilegal trebuie trași la răspundere.

De aceea introducem aceste sancțiuni financiare dure pentru firmele și consilierii frauduloși, protejând integritatea sistemului nostru de imigrație, precum și persoanele vulnerabile care au nevoie reală de consiliere.”

Tot prin proiectul de lege Border Security, Asylum, and Immigration Bill, IAA va putea trage la răspundere advisorii și organizațiile înregistrate, suspendând imediat pe cei suspectați de abuzuri flagrante asupra sistemului de imigrație sau de prejudicierea persoanelor vulnerabile care caută consiliere, și să îi investigheze despre comportamentul lor anterior pe cei care nu mai sunt înregistrați. Această activitate era deja desfășurată de echipa de experți Professional Enabler Disruptions (PED) din cadrul Home Office, care ajută la eliminarea acestui tip de criminalitate.

Lista salariilor de imigrare pentru skilled worker visa

Poți verifica ce locuri de muncă se află pe lista salariilor de imigrare ( immigration salary list) în fiecare regiune din UK

Dacă locul tău de muncă se află pe listă, salariul minim este 80% din rata minimă obișnuită a traseului pentru a te califica pentru o viză Skilled Worker sau Health and Care Worker.

Salariile anuale pentru aceste locuri de muncă sunt calculate pe baza unei săptămâni de lucru de 37,5 ore. Acestea trebuie calculate proporțional, pe baza numărului de ore lucrate pe săptămână declarate de angajatorul tău.

Dacă nu știi codul ocupațional (codul jobului tău), poți căuta locul de muncă aici: CASCOT occupation coding tool.

Dacă te califici pentru rata standard, deoarece ai obținut certificatul de sponsorizare după 4 aprilie 2024, ar trebui să consulți coloana “standard rate”.

Dacă te califici pentru rata redusă, ar trebui să consulți coloana “lower rate”, la care te califici dacă se aplică oricare dintre următoarele:

ETA (Electronic Travel Authorisation) este o permisiune de călătorie pentru cei care vin în vizită în Marea Britanie, care în prezent nu au nevoie de viză pentru vizite scurte, sau care nu au deja un statut de imigrație în UK.

ETA este o permisiune de călătorie – nu este o viză. Nu permite și nu garantează intrarea în Marea Britanie – doar autorizează o persoană să călătorească spre Marea Britanie.

Europenii pot călători cu ETA începand cu 2 aprilie 2025.

Cum se aplică pentru ETA? prin aplicatia „aplicația UK ETA”, care o descărcați din Google Play sau Apple App Store. Puteți aplica online pe GOV.UK dacă nu aveți acces la un smartphone sau aplicați pentru altcineva. Majoritatea solicitanților primesc o decizie automată în câteva minute, ceea ce înseamnă că în continuare se poate călători spontan în UK (totuși se recomandă să aplicați în avans cu cel puțin 3 zile lucrătoare, în caz că situația necesită analiză suplimentară).

Pentru a aplica pentru ETA trebuie să:

Plătiți taxa de £16 (inițial costa £10) .
Dați date de contact și detalii despre pașaport
Furnizați o fotografie valabilă, conform regulilor HO pentru fotografii digitale
Răspundeți la câteva întrebări: dacă aveți job sau nu, dacă aveți și altă naționalitate, dacă aveți condamnări, dacă ați fost implicat /suspect în crime de război, terorism, extremism.

Trebuie să călătoriți cu pașaportul pe care l-ați folosit atunci când ați aplicat pentru ETA.

ETA permite călătorii multiple în UK pentru șederi de până la șase luni pe parcursul a doi ani sau până la expirarea pasaportului – oricare dintre acestea se întâmplă mai devreme.

Reamintim cine nu are nevoie de ETA :

-dacă sunteți scutit de controlul imigrației (exempt from immigration control), dacă aveți o viză, dacă aveți statut de settled sau pre-settled sau right of abode, dacă sunteți în tranzit printr-un aeroport din UK și nu veți trece prin controlul de frontieră, dacă sunteți cetățean britanic sau irlandez, dacă călătoriți cu un pașaport de cetățean al teritoriilor britanice de peste mări (British overseas territories citizen), dacă călătoriți cu un pașaport de British National (Overseas), dacă locuiți în Irlanda și călătoriți din Irlanda, Guernsey, Jersey sau Insula Man, dacă sunteți un copil care călătorește folosind formularul de informații de călătorie pentru excursiile școlare Franța-UK (France-UK school trip travel information form).

Ce se intamplă daca cineva nu poate obține ETA?

Daca cererea de ETA a unei persoane este respinsă, i se va comunica motivul si poate aplica din nou.

Daca vi se refuză ETA, nu puteți face apel și trebuie sa aplicați pentru o viză dacă doriți în continuare permisiunea de a veni în UK.

Este nevoie de ETA pentru cei care tranziteaza prin Marea Britanie? Daca da, de ce?

Guvernul a agreat o excepție temporară pentru pasagerii care tranzitează aerian (airside), si prin urmare, nu trec prin controlul de frontieră al Marii Britanii, de a avea nevoie de ETA. Excepția va fi revizuită periodic.

Pasagerii care tranzitează UK trecând prin controlul de frontieră al Marii Britanii vor avea în continuare nevoie de ETA.

Cum funcționează ETA în Irlanda de Nord?

Marea Britanie nu opereaza control de imigratie la granita terestra Irlanda-Irlanda de Nord, pentru calatoriile din cadrul Common Travel Area. Însă toți cei care sosesc în UK, inclusiv cei care intra prin Irlanda de Nord, trebuie sa respecte Regulile de Imigratie ale Marii Britanii, inclusiv obținerea ETA daca sunt eligibili.

Cetățenii britanici și irlandezi nu au nevoie de ETA și nici rezidentii non-irlandezi cu nationalitati care nu au nevoie de viză pentru UK( cetățenii europeni și americani), cu condiția să aibă dovezi acceptabile ale statusului lor de rezidență. Ghidul complet poate fi gasit aici. Daca acestia calatoresc în UK din afara Common Travel Area, vor avea nevoie de ETA.

Important!

-aplicați pe site-ul oficial. Nu pe orice site vă iese in cale pe google.

-sunt o mulțime de site-uri fake care promit ETA sau care imită site-ul guvernului britanic și care taxează sume mult mai mari ca să aplicați. Evitați-le!

-nu mai plătiți pe alții ca să vă aplice. Datele voastre personale esențiale ajung pe mâna unor necunoscuți.

-raportați suspiciuni de escrocherii online legate de imigrație aici: Avoid and report internet scams and phishing

-verificați dacă aveți ETA sau dacă aplicația a fost primită aici, pe chat: ETA Webchat.

-dacă aveți nevoie de informații despre ETA, luați-le de la sursă, de pe Gov.uk.

În caz că vă întrebați de ce a fost introdusă ETA: că ajută la securitatea frontierelor Marii Britanii, pentru că persoanele care aplică pentru ETA dau detalii biografice, biometrice si de contact și raspund la întrebarile despre eligibilitate si cazier. Pentru Home Office asta înseamnă că vor avea mai multe informații despre cei care vor sa vina în UK, dinainte de îmbarcare și așa previne sosirea celor care prezinta o amenințare.

Revizuirea Immigration Salary List

Pe 4 decembrie 2023, Home Secretary a anunțat mai multe modificări ale sistemului de imigrație, legate de ruta Skilled Worker (SW)

Anunțul guvernului – care urmează să fie implementat începând cu aprilie 2024 – include:

Shortage Occupation List (SOL) va fi înlocuită cu Immigration Salary List (ISL);
Eliminarea reducerii de 20% din ‘going rate’, care anterior era un beneficiu al includerii unei ocupații pe SOL;
Ruta SW (cu excepția vizei Health & Care worker (H&CW)):
- Pragul general a fost majorat de la £26,200 la £38,700. Aceasta reprezintă o creștere de la 25% la 50% (mediana) a ocupațiilor eligibile pentru ruta SW, împreună cu o actualizare a celor mai recente date salariale nominale (Annual Survey of Hours and Earnings – ASHE);
- Creșterea pragurilor specifice ocupației de la 25% la 50% (mediana) a salariului cu normă întreagă pentru ocupațiile non-H&CW sau la scara națională de salarizare, acolo unde este aplicabil; și,
- Pentru ocupațiile de pe ISL, un prag de fie £30,960 sau pragul specific ocupației respective, oricare este mai mare.

Viza Heath&Care Workers:

O excepție care are scopul de a “continua să aducă lucrătorii din domeniul sănătății de care sectorul de îngrijire și NHS-ul au nevoie”;
Pragul general de £29,000 în loc de £38,700.
