Ce s-a schimbat în regulile de imigrație la rezidența EUSS – 5 martie 2026

Astăzi, 5 martie 2026, a fost prezentat Parlamentului Memorandumul explicativ la schimbările regulilor de imigrație introduse de HC 1691, adoptate în temeiul prevederilor secțiunii 1(4) și secțiunii 3(2) din Immigration Act 1971, folosite pentru a reglementa intrarea și șederea persoanelor în UK.

4.2 Modificările Appendix EU care îi privesc pe cetățenii europeni:

5.53 EU Settlement Scheme (EUSS) permite cetățenilor din UE, din alte state ale European Economic Area (EEA) și cetățenilor elvețieni care locuiau în UK înainte de sfârșitul perioadei de tranziție după ieșirea din UE, la ora 23:00 GMT, la 31 December 2020, precum și membrilor familiilor lor, să obțină statutul de imigrație de care au nevoie pentru a continua să locuiască în UK, în conformitate cu Citizens’ Rights Agreements. EUSS family permit permite membrilor de familie relevanți să călătorească în UK, unde pot aplica la rezidență pentru a rămâne în UK împreună cu sponsorul lor.

5.54) Modificările aduse Immigration Rules pentru EUSS în Appendix EU sunt următoarele:

-Pentru a combate abuzurile identificate prin care cetățeni europeni sponsorizează aplicații la rezidență EUSS depuse de persoane care pretind în mod fals că sunt membri de familie eligibili, se introduce o nouă cerință de suitability, aliniată cu regulile deja existente privind scurtarea permisiunii de ședere(curtailment), care, acolo unde este proporțional să se procedeze așa, va permite respingerea unei aplicații EUSS atunci când este mai probabil decât improbabil că, după sfârșitul perioadei de tranziție, persoana a ajutat în mod fraudulos o altă persoană să obțină sau să încerce să obțină entry clearance ori leave to enter sau remain în UK.

-Să simplifice prevederea actuală care permite unei persoane să depună o nouă aplicație la EUSS în orice moment atunci când deține pre-settled status acordat în cadrul schemei.

-Să extindă prevederea actuală care permite unui solicitant non-european să poată folosi un card de reședință biometric expirat ca dovadă a identității și naționalității, dacă a expirat în ultimele 60 de luni (în loc de 18 luni). Astfel, cetățenii non-EEA pot continua să aplice online, fără să fie nevoiți să meargă la o programare biometrică.

Modificări ale Appendix EU (Family Permit) – cerințe suplimentare de valabilitate

5.55. La mai mult de cinci ani după sfârșitul perioadei de tranziție după ieșirea din UE, se observă în continuare tentative de abuz ale rutei family permit EUSS din partea unor persoane care pretind în mod fals că au un sponsor cetățean EEA eligibil sau o relație de familie eligibilă. Prin urmare, modificările aduse Immigration Rules pentru EUSS family permit în Appendix EU (Family Permit) introduc cerințe suplimentare de valabilitate pentru a permite respingerea aplicațiilor care nu intră în domeniul schemei și îmbunătățirea serviciilor pentru solicitanții pe această rută, după cum urmează:

Solicitantul trebuie să furnizeze dovada statutului EUSS al sponsorului (UAN- Unique Application Number) sau informații ori dovezi care, în opinia ofițerului vamal, indică faptul că sponsorul este „relevant EEA citizen”.

Solicitantul trebuie să furnizeze informații sau dovezi care, în opinia ofițerului vamal, indică faptul că relația de familie cu sponsorul intră în domeniul rutei, de exemplu un certificat de căsătorie sau un certificat de naștere (care, cu excepția cazului în care există îndoieli rezonabile privind autenticitatea, poate fi o copie și nu documentul original). Evaluarea propriu-zisă a faptului dacă acea relație de familie îndeplinește cerințele de eligibilitate pentru un EUSS family permit va continua să fie realizată ca parte a procesului de analiză a cazului pentru o aplicație validă.

***Dacă paragraful 5.54 nu vă este clar, în esență înseamnă că dacă Home Office consideră că sponsorul a ajutat pe altcineva să obțină sau să încerce să obțină fraudulos dreptul de ședere în UK sau o viză (de exemplu pretinzând fals că este membru de familie), atunci îi poate refuza o aplicație pe care o face ulterior, sau îi poate scurta / retrage statusul. Regula nu vizează doar solicitantul care minte, ci și persoana care îl ajută sau îl sponsorizează. Dacă ai participat la o fraudă de imigrație pentru a ajuta pe cineva să intre sau să rămână în UK, asta poate afecta propriul tău statut de rezidență în UK.

“Acesta a fost mereu cazul (mai ales din 2022), dar era aproape exclusiv în competența SRU (în cadrul EUSS). Aceste schimbări extind puterile discreționare ale EUCWs și permit ca analiza de suitability făcută atunci când este evaluată o aplicație (similară analizei de „Good Character” din aplicațiile de naturalizare) să poată duce la curtailment.

Așadar, în esență, aceste schimbări extind semnificativ puterile sistemului, per ansamblu, de a se ocupa de (a se citi: de a sancționa corespunzător) pe cei care au comis fraudă de imigrație. Și nu va exista posibilitatea de a te ascunde, decât dacă cineva are o mașină de călătorit în timp… pentru că, dacă ai comis acest tip de fraudă în 2023, nu există nicio modalitate de a o „anula”.

De remarcat (de asemenea, Români în Anglia Grup Oficial) că schimbarea de mai sus, care privește retroactiv infracțiunile de imigrație comise până acum, este întărită suplimentar ca factor de descurajare, deoarece este cuplată cu extinderea domeniului de aplicare al analizei de validity (care, astfel, privește înainte).

Aceasta – analiza mai largă de validity – va avea un impact foarte mare în oprirea JFM falși (joining family members) care depun aplicații succesive fără sens pe baza unor membri de familie fictivi (adică „cumpărarea” de UAN-uri prin intermediul escrocilor). Un solicitant JFM trebuie acum să dovedească încă de la început (adică din etapa de validity) că este rudă sau într-o relație cu sponsorul său, înainte ca aplicația să fie considerată validă. Și la fel cum schimbarea privind analiza de validity din 2023 (și apoi din 2024) a dus la o scădere majoră a numărului de fraude (reducând semnificativ grupul „de la CoA la CoA”), aceste noi schimbări vor închide, în timp, practic ușa pentru astfel de tentative frauduloase.

Și, revenind la primul punct: pentru jumătatea din grupul „de la CoA la CoA” care chiar sunt rude sau într-o relație cu sponsorul lor EEA relevant (deci nu au „cumpărat” pur și simplu UAN-ul cuiva de la un escroc), prima parte a schimbărilor (cea în care analiza de suitability poate duce la curtailment) ar trebui să fie un factor de descurajare major.

Nu mai există „hai să aplicăm pentru că e gratis și nu se întâmplă nimic”… cu aceste schimbări, orice sponsor relevant EEA/EU ar trebui să se gândească de două ori (de trei, patru, cinci ori) înainte să accepte să sponsorizeze pe cineva în cadrul EUSS.”

Pre-settled se prelungește cu 2 ani pentru cei care nu aplică pentru settled

Home Office a anunțat că, începând cu luna septembrie 2023, persoanele cu pre-settled care nu au solicitat încă statutul de settled, vor avea automat statusul extins cu 2 ani, înainte de expirarea statusului Pre-Settled existent.

Noile reguli de imigrare, prezentate astăzi 17 iulie în Parlament, confirmă că, din septembrie 2023, persoanele cu pre-settled status în cadrul EU Settlement Scheme (EUSS) vor avea automat statusul extins cu 2 ani înainte de expirare, dacă nu au obținut settled status. Acest lucru va asigura că nimeni nu își pierde statusul de imigrare dacă nu aplică pentru trecerea de la pre-settled la settled status.
Home Office va notifica direct despre extensia statusului pre-settled, prin e-mail, în majoritatea cazurilor. Procesul va fi automatizat de către Home Office, care va extinde automat statusul Pre-settled la începutul fiecărei luni pentru cei cărora le va expira la sfârșitul lunii următoare. Aceasta înseamnă că prelungirile vor avea loc cu o lună până la două luni înainte de data inițială de expirare a statusului pre-settled. Exemplu: la începutul lunii martie 2024, extensiile se vor aplica la pre-settled-urile care expiră înainte de sfârșitul lunii aprilie 2024. Prelungirea va fi afișată și digital, în contul de imigrație UKVI.

Home Office va adopta măsuri pentru convertirea automată a celor cu pre-settled care se califică pentru settled, odată ce sunt eligibili pentru acesta, fără a fi necesar să aplice. În cursul anului 2024, verificările automate ale statusului pre-settled vor stabili prezența lor continuă în UK. Se vor lua măsuri de siguranță pentru a se asigura că settled status nu este acordat în mod eronat.

Pentru a proteja aceasta schemă de fraudă și abuz, se va schimba și modul cum vor fi considerate motivele întemeiate pentru aplicațiile întârziate și se închid două rute temporare de tranziție ( Surinder Singh and Zambrano ambele în afara angajamentelor Acordului de Retragere al Marii Britanii) pentru noi aplicanți.

La 31 martie 2023, se estima că 5,6 milioane de europeni și membrii familiilor acestora și-au asigurat drepturile în UK prin intermediul EUSS, cu aproximativ 2,1 milioane deținând pre-settled status și aproximativ 3,5 milioane deținând settled status.

Gladstone District Community Association (GLADCA)

GLADCA are registered with the OISC and became Level 2 approved in 2010, we have been working with the UK Border Agency and delivering immigration advice to immigrants who hold ILR/PR and general EU status since this date. The Refugee and Migrant Centre

Aviz amatorilor de acte false si făcătorilor de falsuri

Acest material trateaza doar situatia celor ne-eligibili , care nu intrunesc conditiile de aplicare pentru rezidenta.

Au trecut mai mult de 200 de zile de la sfarsitul perioadei de gratie in care cetatenii europeni care au fost in UK pana la data de 31 dec 2020, puteau aplica pentru schema de rezidenta EU Settlement Scheme. Mai mult de 172 000 de aplicatii au fost facute dupa deadline – intre 30 iunie 2021(data limita) si sfarsitul lui septembrie (un total de 333 200 pana in decembrie) si inca se mai fac, pentru ca cei care vor sa vina oricum, chiar daca nu intrunesc conditiile, sunt extrem de multi si sunt dezinformati, pacaliti sau “ajutati” sa aplice la noroc.

Ceea ce nu stiu “indemnătorii” si făcătorii intru facturi, payslipuri, si alte dovezi de prezenta falsificate – care profita de aceasta oportunitate si-i indeamna pe cei care nu se califica deloc sa aplice cu acte produse de ei, e ca, in afara de dovada de prezenta in ultimele 6 luni ale anului trecut, a mai aparut o cerinta in aplicatia intarziata pentru settlement: one piece of evidence dated within the 6 month before your application(o dovada de prezenta datata in ultimele 6 luni dinaintea aplicatiei). Floare la ureche, s-ar spune, or sa foloseasca biletul de avion cu care au sosit sau, pentru ca au venit la noroc, pe șest si nu pot face nimic fara acte, or sa mai cumpere de la careva o factura datata in ultimele 6 luni dinaintea aplicatiei, pe langa falsurile pe care le-au cumparat ca sa demonstreze ca au fost in uk, dar nu au aplicat la timp.

Doar ca de la 1 oct. nu mai mai intra in UK decat cu pasaportul, care pasaport, ghinion, contine toate informatiile despre unde si cand a fost folosit. Asa ca Home Office stie:

– ca Nelutzu – care n-a calcat in viata lui in UK si care a aplicat in acum in octombrie 2021, cu documente proband ca a intarziat pentru ca a fost bolnav, izolat sau vulnerabil si a prezentat un bill la apa sau payslip din dec 2020 si unul de prin vara asta eventual – Nelutzu asta minte in aplicatie si foloseste falsuri in scopul obtinerii rezidentei.

-iar daca acelasi Nelutzu care n-a mai calcat vreodata in UK, aplica din Romania pentru rezidenta, cu aceleasi acte procurate de la facatorii de bine de pe fb, pentru ca ii trebuie Certificatul de aplicare(COA) cu care crede ca poate intra fara probleme, atunci Home Office iara stie asta din datele pasaportului folosit la intrarea in UK si desi are COA nu-l lasa se intre.

– Home Office verifica repetat aplicatiile in timp, si dupa acordarea rezidentei.

Pentru cei doritori de venit in UK la munca, care nu se califica pentru acea schema de rezidenta si sunt tentati sa treaca pe sub lege apeland la falsuri, las o nota cu informatii mai jos, continand doar cateva offences.
