ROBINETUL ÎNCEPE SĂ FIE STRÂNS ȘI UȘA SE ÎNCHIDE POLITICOS, DAR FERM – partea I

Mai țineți minte argumentul ăsta aruncat de 2 ani încoace prin toate grupurile: “Atâta vreme cât se poate aplica se poate și obține”? Ei, nu mai.

“Pentru toți cei care așteptau cu sufletul la gură acest moment [din diferite motive:

– că se săturaseră să vadă toate țepele “duamnelor și domnilor contabili” de pe Facebook;

– că se săturaseră de inegalitatea dintre cei care încercau să respecte legea și erau refuzați pe bun drept versus cei care făceau aplicație după aplicație la plezneală și stăteau cu anii ilegal prin UK;

– că se săturasera să tot citească despre “am cele 7 pagini/am CoA/am aplicat și eu la rezidență…. pot sa vin la muncă? pot să iau beneficii?”;

– că se săturaseră de lipsa de claritate a sistemului (“dar dacă cineva a aplicat la plezneală, de ce angajatorul poate să îi verifice dreptul de muncă?”)

– și din multe alte motive, unele mai Schadenfreude decât altele…]

Iată că a venit momentul mult-așteptat: ROBINETUL ÎNCEPE SĂ FIE STRÂNS ȘI UȘA SE ÎNCHIDE POLITICOS, DAR FERM.

Ce înseamnă aceste schimbări (schimbările sunt multe, însa să ne concentrăm pe 3 dintre cele mai importante):

1. când cineva face o aplicație la plezneală (chiar daca a fost cateva zile in 2020 in UK și nu are doar dovezi false cumparate de pe FB), de acum încolo nu se mai dă CoA automat, cum se dădea până acum, ci se verifică mai întâi “validity” înainte de “eligibility“. Iar la “validity” (=validitatea aplicației) acum intră și data aplicației. Pentru că a trecut acel 1 iulie 2021 de 2 ani+, acum trebuie justificat cu dovezi foarte serioase de ce se aplică întârziat. Nu mai e ca până acum, dădeai cu subsemnatul la o propoziție scoasă din burtă cu o justificare inventată: acum trebuie dovezi și doar foarte puține explicații mai sunt acceptate. Marea majoritate a aplicațiilor întârziate acum vor fi refuzate instant, la stadiul primar, înainte de acordarea Certificatului de Aplicare.

2. aplicațiile repetate, veșnice, ca să rămână cineva la muncă în UK din CoA in CoA (adică imediat ce primea un refuz făcea o nouă aplicație ca să ia share code din nou) nu o să mai fie permise decât în anumite situații, și acestea extraordinar de restrânse (și, la fel ca la pct 1: vor trebui justificate cu documente serioase). Majoritatea (covârșitoarea majoritate) a aplicațiilor repetate vor fi de acum refuzate înainte de acordarea Certificatului de Aplicație. Deci se închide robinetul de acces la Sharecode pentru oricine.

3. aplicațiile membrilor de familie continuă să se facă OBLIGATORIU doar din țara de origine (în acest caz din România) și răspunsul acum se așteaptă OBLIGATORIU din Romania. CoA a fost introdus explicit pe lista documentelor ce nu mai sunt permise pentru traversarea frontierei. Ce rămâne neschimbat: venitul ca “vizitatorcând ai intenția să aplici la schema de rezidență ca membru de familie – acest lucru continuă să fie încalcare flagrantă a legii, pentru că presupune a minți la frontieră (da, chiar dacă ai trecut pe la e-gates și nu ai interacționat cu niciun vameș). If you have settled or pre-settled status under the EU Settlement Scheme

You can enter the UK with one of the following identity documents:

  • a passport
  • an Irish passport card
  • a national identity card issued by an EU country, Switzerland, Norway, Iceland or Liechtenstein

Your passport or identity card must be registered on your UK Visas and Immigration account.

If you have applied to the EU Settlement Scheme but are waiting for a decision

If you were living in UK by 31 December 2020 and applied by 30 June 2021

You can enter the UK with one of the following identity documents:

  • a passport
  • an Irish passport card
  • a national identity card issued by an EU country, Switzerland, Norway, Iceland or Liechtenstein

Your Certificate of Application to the EU Settlement Scheme can be confirmed at the border if needed, but you can also bring a copy with you when you travel.

If you were living in UK by 31 December 2020 but applied after 30 June 2021

You can enter the UK with one of the following identity documents:

  • a passport
  • an Irish passport card
  • a national identity card issued by an EU country, Switzerland, Norway, Iceland or Liechtenstein

Your Certificate of Application to the EU Settlement Scheme can be confirmed at the border if needed, but you can also bring a copy with you when you travel.

You may also be asked to show evidence that you were living in the UK by 31 December 2020.

If you were not living in the UK by 31 December 2020 and have applied to the EU Settlement Scheme as a joining family member

You must enter the UK with your passport. You must also have a document showing you’re allowed to enter the UK such as:

  • a UK issued biometric residence card
  • an EU Settlement Scheme family permit
  • an EEA family permit

You can use these documents even if they have expired.

If you don’t have one of these documents you should wait to travel to the UK until your application has been decided as you may be refused entry.

If you have an EU Settlement Scheme family permit

You can enter the UK with one of the following identity documents:

  • a passport
  • an Irish passport card
  • a national identity card issued by an EU country, Switzerland, Norway, Iceland or Liechtenstein

You may also be asked to show your EU Settlement Scheme family permit which can be in date or expired. If your permit is expired, you may be asked to show evidence that you’ve applied to the EU Settlement Scheme, such as a Certificate of Application, or provide reasons why you have not yet done so.

If you intend to apply to the EU Settlement Scheme or for an EU Settlement Scheme family permit but have not yet done so

You should apply to the EU Settlement Scheme or for an EU Settlement Scheme family permit from outside the UK if you’re eligible.

Otherwise, you should check if you need a visa.

If you have a document issued under the EEA Regulations 2016

You should apply to the EU Settlement Scheme if you have a:

  • registration certificate
  • document certifying permanent residence

You should apply even if your document has not expired.

Gladstone District Community Association (GLADCA)

GLADCA are registered with the OISC and became Level 2 approved in 2010, we have been working with the UK Border Agency and delivering immigration advice to immigrants who hold ILR/PR and general EU status since this date. We fully understand the requirements of the immigration service and are practiced at completing the paperwork required. We fully understand the needs of vulnerable and at risk EU citizens and have established links with stakeholders and within the local communities in order to engage eligible individuals.

GLADCA have delivered the EU Settlement Scheme within Peterborough since 2019. During this period, we successfully engaged and supported over 2350 vulnerable people to complete their EU Settlement Scheme application. We have staff in post who have considerable experience in managing and delivering projects and have been deployed on our existing EUSS programme delivery. We have robust systems and processes in place (Financial, quality, safeguarding, prevent, IT security, GDPR, performance management, staffing, training) in accordance with Home Office reporting requirements.

International Organization for Migration (IOM)

The Refugee and Migrant Centre

RMC is regulated by the Office of the Immigration Services Commissioner (OISC) and is accredited to provide free immigration advice up to Level 3 of OISC which also includes representation before the First-tier and Upper Tribunal.

We provide free immigration advice and representation to migrants (including undocumented migrants), EEA nationals and their family members, refugees and asylum-seekers to enable them to navigate the UK’s complex immigration legal system and secure the right to remain in the UK for themselves and their families.

Rights of Women

Our telephone advice line provides legal advice and assistance to women who are vulnerable due to Violence Against Women and Girls (VAWG) to enable them to apply to the EU Settlement Scheme.
